<br />City of Roseville <br /> <br />PRE-EXISTING NONCONFORMING USES DEFINITIONS AND PROCEDURE <br /> <br />Draft: August 7, 2002 <br /> <br />Definitions: Pre-existing Nonconforming Lots, Uses and Structures <br /> <br />Within the Roseville Zoning Code and Districts, lots, uses of land, and structures exist which <br />were permitted before the ordinances were passed or amended. These may be prohibited, <br />regulated, or restricted under the terms of the current City Code or future amendments. It is the <br />intent of the Roseville Zoning Code to permit these per-existing nonconforming lots, uses and <br />structures to continue so long as they remain otherwise consistent with the City Codes. <br /> <br />1. The following provisions apply in determining the nonconforming status and whether the <br />lot, use or structure may be altered or further developed. <br /> <br />a. Within a multi-tenant building or single use building a business that includes a <br />pre-existing, nonconforming use cannot intensify that pre-existing nonconforming <br />use portion of the business. "Intensified use" is defined as a use that would create <br />a substantially more detrimental impact to the building or adjacent area. (See the <br />attached definition of "detrimental impact"). <br /> <br />b. A nonconfonning lot, use or structure may not be enlarged, moved, changed or <br />extended beyond the scope and area of its operation or the exterior building <br />dimensions at the time when it became a legal nonconforming use. Any structure <br />or portion thereof may be altered to decrease its non-conformity. <br /> <br />c. Uses or structures, which are prohibited elsewhere in the same zoning district, are <br />not pelmitted to move to lots with other nonconforming uses or structures. <br /> <br />d. Should a structure be moved for any reason for any distance, it will thereafter <br />conform to the regulations for the district in which it is located after it is moved. <br /> <br />e. If any legal pre-existing nonconforming use of land, structure (or portion thereof), <br />or combination, is changed to a permitted use, then the legal nonconforming use <br />status is removed and cannot be resumed. <br /> <br />f. When a legal, pre-existing nonconforming use of land, structure (or pOliion <br />thereof), or combination is discontinued or abandoned for twelve (12) consecutive <br />months, the nonconforming use status is removed and cannot be resumed. <br /> <br />g. Normal maintenance and repair of a pre-existing nonconfonning structure may be <br />performed provided there is no significant physical change to the structure and <br />such maintenance and repair does not extend, enlarge the exterior dimensions of <br />the nonconforming structure or intensify the pre-existing, nonconforming use of <br />the structure, unless othelwise authorized by the City Code. <br /> <br />PF3359 - RPCA(080702) Page 6 of8 <br />
