1) Existing uses, whether conforming to the B-6 district requirements. as
permitted uses, PUDs, or non-conforming uses, may remain in their current
locations and configuration as long as they wish to operate there. However,
expansion and/or intensification of pre-existing non-conforming uses will not
be permitted. (See City Attorney Jamnik's description of non-conforming
uses, dated 06/05/02. Also see the B-6 Zoning District Ordinance of 12/17/01
for permitted uses.)

2) Conforming uses that wish to expand will be evaluated on a case by case basis
as to whether the expansion will meet the size, area, and improvement
requirements of the Environmental Impact Statement done for the Twin Lakes
Master Plan as well as those of the B-6 zone at the time they apply for a
building permit, or at such earlier time as the property owner requests such a
determination. In general, a pre-existing use expanding in an existing building
is permitted. A mix of existing uses, some permitted some not permitted,
being renovated or expanded within the walls of the existing building, and
meeting the environmental, life/safety, and building code requirements, will
be allowed.

3) Truck traffic should be minimized as much as possible and still serve the
needs of the businesses in the Business Park. Distribution companies and
truck terminals with fleets of trucks are encouraged to locate west ofI-35W in
the remaining industrial areas.

4) By design and management, traffic should have incentives created by the road
system to use the Parkway and Interstate; County Road C, and Snelling
Avenue as much as possible. Traffic should be discouraged from using
Fairview A venue and cutting through the adjoining residential areas.

5) Noise in a business park must meet the MnPCA Noise Standards and should
be compatible with office, research, laboratory, and residential uses which
may be next door. Industrial and manufacturing noises such as air horns, high
pitched or pressure releasing exhausts, whistles, and engine whines, dust bag
banging, metal stamping are acceptable in industrial districts, but new uses
with such sound emissions would not be permitted in a B-6 business park
district.

6) Air quality is another concern. New industrial equipment in a pre-existing use
will be considered intensification if it emits more untreated exhausts or may
create nuisance or sickening situations either on the site or in nearby sites.

7) Surface water is also a concern. New untreated runoff from buildings or roofs,
without on-site corresponding holding basins, will be considered
intensification.

2
