DAVIS <br /> <br />December <br /> <br /> <br />REPLY TO: <br />Roseville <br /> <br />Mr. Rick Jopke <br />City of Roseville <br />2660 Civic Center Drive <br />Roseville, MN 55113 <br /> <br />RE: SETBACK REQUIREMENTS FOR LAKE SHORE ZONING <br />Our File No. 1011.19 <br /> <br />Dear Mr. Jopke: <br /> <br />You have requested an opinion as follows: <br /> <br />"Please provide me with a written opinion on whether <br />or not fences are subject to the 75 foot setback <br />requirement from the ordinary high water mark of a <br />lake (See S18.100)". <br /> <br />In our opinion, fences are not subject to the 75 foot setback and <br />may be allowed. Setbacks from lakeshore are regulated by ~18.100 <br />of the Roseville City Code. <br /> <br />Parts of Roseville's lakeshore zoning ordinances have been <br />adopted from regulations promulgated by the Minnesota Department <br />of Natural Resources. The DNR has promulgated the following <br />definition in its rules: <br /> <br />"6120.2500, Subp. 16 structure. 'Structure', means <br />any building or appurtenance thereto, except aerial or <br />underground utility lines, such as sewer, electric, <br />telephone, telegraph, or gas lines, including towers, <br />poles, and other supporting appurtenances." <br /> <br />This definition of the DNR is identical to that found in the <br />Roseville City Code S18.080, subp. 10. <br /> <br />M~8 <br />
