March 12, 2002

Mr. Larry J. Berg
Fredrikson & Byron, P.A.
1100 International Centre
900 Second Avenue South
Minneapolis, MN 55402-3397

RE: Thomas Willmus Minor SubdivisionlVariance Request.

Dear Mr. Berg:

The Community Development Department of the City of Roseville has reviewed the request
submitted by your office on behalf of Mr. Thomas Willmus, 3040 Hamline Avenue.

Initially, we had discussed placing this item on the March 6, 2002 Planning Commission agenda
for action. However, after notice was given to residents within 350 feet of the subject parcel, the
City received calls from neighboring property owners. Specifically, the Community
Development Department discussed the proposal with Mr. Dougherty the neighboring (north)
property owner.

After our conversation we determined that it would be in everyone's interest to discuss the
request to determine whether an amicable compromise could be reached prior to forwarding to
the Planning Commission for action. Toward that end, staff and the City Attorney met with Mr.
Dougherty and his attorney on March 11,2002. At that meeting, Mr. Dougherty asserted his
position that Mr. Willmus does not have access from Tract B (parcels 1 and 2) to Hamline
A venue.

We asked Mr. Dougherty to formalize his position by letter. Upon receipt of this letter, we will
make an administrative decision on whether the minor subdivision/lot line adjustment you have
proposed can be approved or whether it should be denied.

Should you have any questions or comments, please feel free to call me at 651-490-2236.

Sincerely,

CITY of ROSEVILLE

Thomas Paschke
City Planner

2660 Civic Center Drive .:.
