Beisel <br />Hoeschler & Beisel, LLP <br />282 US Trust Center <br />730 Second Avenue South <br />Minneapolis, Minnesota 55402-2444 <br /> <br />Re: City of Roseville - Willmus/Dougherty Dispute <br /> <br />Gentlemen: <br /> <br />Thank you for your patience as we reviewed this matter to determine whether the City <br />has the authority to approve a request to resubdivide or adjust the lot lines for the afore- <br />mentioned property. <br /> <br />After carefully reviewing the submissions you each have provided, and researching the <br />past litigation surrounding this parcel, I have concluded that the City of Roseville cannot <br />approve the proposed adjustment of the lot lines for Lots 1 and 2 (Tract B). As proposed, <br />access to the properties (property) would be across Lot 24 necessitating a transfer of title or an <br />easement. <br /> <br />It is my opinion that though inartfully worded, the Court of Appeals' decision in the <br />previous litigation established that Lot 24 is "not encumbered by an easement" for the benefit <br />of Tract B and consequently to Lots 1 and 2. <br /> <br />It is my opinion that the City may not, pursuant to Minn. Stat. S 505 and the Roseville <br />City Code, approve the proposal as submitted, nor may a building permit be issued at this time <br />for either lot due to the inadequate access. <br /> <br />Suite 317 .
