<br />4.0 PROJECT SPECIFICS: <br /> <br />4.1 Love From Minnesota conducts business at 2456 Fairview Avenue, which site is shared <br />with Bayberry Creek. Each site sell Minnesota novelties, while Bayberry Creek acts <br />more as a cafe/deli and Love From Minnesota a retailer of crafts, shirts, and furniture. <br /> <br />4.2 Section IOB.OlD of the City Code describes the criteria which must be used to evaluate <br />a CUP. They are as follows: <br /> <br />a. Impact on traffic. <br />b. Impact on parks, streets and other public facilities. <br />c. Compatibility of the site plan, internal traffic circulation, landscaping and <br />structures with contiguous properties. <br />d. Impact of the use on the market value of contiguous properties. <br />e. Impact on the general public health, safety and welfare. <br />f Compatibility with the City's Comprehensive Plan. <br /> <br />4.3 The CUP process also allows the City to impose those conditions it considers necessary <br />to protect the public health, safety, and welfare. <br /> <br />4.4 Love From Minnesota is proposing to use a 1,600 square foot area within the structure <br />for the purpose of selling Minnesota wine. No additions will be made to the existing of <br />the building. <br /> <br />5.0 STAFF FINDINGS: <br /> <br />5.1 The Community Development Staff has reviewed the proposed additional use of the site <br />for retail (off-sale) wine sales to the CUP evaluation criteria listed in Section IOB.01D <br />and concluded that the proposal meets these criteria. Specifically, the proposed use will <br />not dramatically increase traffic to the (destination) site, nor will the proposed use <br />increase the need for additional on-site parking. The proposed use is consistent with the <br />existing uses within the facility and is consistent with the surrounding mix of office, <br />showroom, and retail uses. Hence, the building and the proposed new use will not have <br />an impact on surrounding property or values. There appears to be no impact on general <br />health, safety, and public welfare. <br /> <br />5.2 Love From Minnesota will need to meet the requirements of Section 302.13 Off Sale <br />License Regulations of the Roseville City Code. Specifically a license is required; the <br />size of the sales area must be a minimum of 1,600 square feet; and said license must meet <br />other applicable requirements of Section 302. <br /> <br />6.0 STAFF RECOMMENDATION W jCONDITIONS: <br /> <br />6.1 The City Staff recommends approval of the request by Love From Minnesota for a <br />Conditional Use Permit to allow the off-sale wine sales on the premises located at 2465 <br />Fairview Avenue, subject to the following conditions: <br /> <br />PF3381 RPCA CUP 030602 <br /> <br />Page2of3 <br />
