subject to specific conditions considered reasonable and/or necessary for the protection <br />45 <br />of the public health, safety, and general welfare. <br />46 <br />Section 1009.03D of the City Code specifies that three specific findings must be made in order to <br />47 <br />approve a proposed interim use: <br />48 <br />a. <br />The proposed use will not impose additional costs on the public if it is necessary for the <br />49 <br />public to take the property inthe future.Because the service and storage of boats is similar to <br />50 <br />the historical use of the subject property for storage and service of buses and semi-trailers, <br />51 <br />Planning Division staff believes that thecontinuation of theinterim usewould not <br />52 <br />significantly exacerbate negative impactson the landwhich may have occurred at any time <br />53 <br />during the past 40 years or more. <br />54 <br />b. <br />The proposed use will not create an excessive burden on parks, streets, and other public <br />55 <br />facilities.Ten years of outdoor storage use has notproven to impose anexcessive burden on <br />56 <br />streets, parks, or other facilities, and Planning Division staff believes that renewed approval <br />57 <br />will not lead to any increases is such impacts. <br />58 <br />c. <br />The proposed use will not be injurious to the surrounding neighborhood or otherwise harm <br />59 <br />the public health, safety, and general welfare.Feedback offered at the applicant’s November <br />60 <br />th <br />17open housemeeting suggests that the outdoor storage use has not beeninjurious to the <br />61 <br />surrounding neighborhood or otherwise harmful tothe public health, safety, and general <br />62 <br />welfare, and Planning Division staff has no reason to expect otherwise if the approval is <br />63 <br />renewed. <br />64 <br />In any case, if an approved interim usefails to conform to any of these requirements or <br />65 <br />conditions of the approval and such problems are not or cannot be reasonably resolved, the City <br />66 <br />may initiate a public hearing process to revoke the approval. <br />67 <br />The Development Review Committee (DRC) reviewed this application at its November 13, <br />68 <br />2014,meetingand the screening of the storagearea was the only topic of concern. The chain link <br />69 <br />fence with fabric panels does not conform to the minimum standards for screening, but it was <br />70 <br />supported for Boaters Outlet because it is a temporary use on a property that has been poised for <br />71 <br />redevelopment. This screening continues to be acceptable for thesame reason, but the screening <br />72 <br />is absent from the gate and from the small section of fence abutting the building. Fabric panels <br />73 <br />should be installed in these areas to complete the screening as viewed from County Road C.And <br />74 <br />since redevelopment of the surrounding properties, and the potential for new sight lines from new <br />75 <br />public or semi-publiclocations, seems to be as much a possibility as redevelopment of the <br />76 <br />subject site, the DRC recommends requiring the remainder of the outdoor storage area to be <br />77 <br />screened, consistent with the standard screening requirements for outdoor storage uses, by the <br />78 <br />time redevelopment of any of the surrounding parcels has been completed. <br />79 <br />PC <br />UBLIC OMMENT <br />80 <br />At the time this report was prepared, Planning Division staff hadnotreceived any additional <br />81 <br />communicationsfrom the publicaboutthe interim use request. <br />82 <br />PDR <br />LANNING IVISIONECOMMENDATION <br />83 <br />Based on the comments and findings outlined above inthis report, the Planning Division <br />84 <br />recommendsrenewed approval of the proposed interim use, subject to the following conditions: <br />85 <br />a. <br />The outdoor storage area shall continue to be adequately screened as viewed from County <br />86 <br />Road C.
