Attachment E <br />EXTRACT OF MINUTES OF MEETING OF THE <br />VARIANCE BOARDOF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, apublic hearing was held at theregular meeting of the <br />1 <br />rd <br />Variance Boardof the City of Roseville, County of Ramsey, Minnesota, on the 3day of <br />2 <br />December 2014, at 5:30p.m. <br />3 <br />The following members were present: _________; <br />4 <br />and____wasabsent. <br />5 <br />Variance Board Member______introduced the following resolution and moved its adoption: <br />6 <br />VB RESOLUTION NO. 110 <br />7 <br />A RESOLUTION APPROVINGA VARIANCE TO §1004.08(IMPROVEMENT AREA) <br />8 <br />OF THE CITY CODE TO ALLOW THE PROPOSED EXCESS PAVED SURFACES <br />9 <br />AND BUILDING FOOTPRINTS AT 365 S OWASSO BOULEVARD(PF14-030) <br />10 <br />WHEREAS, the subject property is legally described as: <br />11 <br />PIN: 01-29-23-12-0072 <br />12 <br />All of Lot 7 of Lake Owasso Villa and Lot 8 of Lake Owasso Villa save andexcept that <br />13 <br />portion of said Lot 8 described as follows: Beginning at theNorthwesterly corner of Lot 8 <br />14 <br />Lake Owosso Villa, thence Northeasterly along theNortherly line of said Lot 8for a <br />15 <br />distance of 40 feet; thence Southerly to a point on the Southerly line of said Lot 8, 30feet <br />16 <br />Easterly of the Southwesterlycorner of said Lot 8; thence Westerly along the Southerly line <br />17 <br />of said Lot 8,30 feet to the Southwesterly corner thereof; thence Northerly along the <br />18 <br />Westerly line of sold Lot 8to the Northwesterly corner of said Lot 8, being thepoint of <br />19 <br />beginning, Ramsey County, Minnesota. <br />20 <br />WHEREAS, City Code §1004.08limits paved surfaces and building footprints to 25% of <br />21 <br />the parcel area of the subject property;and <br />22 <br />WHEREAS, Zawadski Homes, Inc., owner of the subject property,hasrequesteda <br />23 <br />variancesto City Code §1004.08to allow proposed paved surfaces and building footprints <br />24 <br />covering 29.9% of the property;and <br />25 <br />WHEREAS,City Code §1009.04 (Variances) establishes that the purpose of a varianceis <br />26 <br />“to permit adjustment to the zoning regulations where there are practical difficulties applying to a <br />27 <br />parcel of land or building that prevent the property from being used to the extent intended by the <br />28 <br />zoning;” and <br />29 <br />WHEREAS,the VarianceBoardhas made the following findings: <br />30 <br />a. <br />The practical difficulty stems from the fact that the proposed improvements would <br />31 <br />likely be permitted by amended zoning provisionscurrently being prepared by <br />32 <br />Roseville’s Engineering Division staff, but the amendmentmay take a considerable <br />33 <br />Page 1of 3 <br /> <br />
