<br />A fence, by Webster's definition, is ". .. a barrier intended to prevent escape or intrusion or to <br />mark a boundary. . ." Mr. Hoff s fence provides no escape route and the intrusion by anyone. <br />This fence has an impact on the sightlines of the neighbors; the sightline of the entire shoreline <br />of MCCarron's Lake and indeed, it obstructs the view of the recreational users of the lake. <br /> <br />Shoreline owners interpret their front yard as that portion that faces the lake. The 'Roseville's <br />Shoreland District' Code has no set back requirement. The 'Code" also has ambiguities. Back <br />yards on lake home properties should have setback requirements as well as height requirements. <br />Fences should be transparent. Fences of six feet (72") or less are not regulated. Front yard <br />fencing has a regulated height of 48" so as not to change the vista by adjacent property owners <br />and also for safety reasons of the motoring public. No other lake in Roseville has a fence like this <br /> <br />one. <br /> <br />The 'Code' to the lake should have the same as front yards: the fence should be transparent so as <br />not to destroy the vista of the adjacent properties, the other property owners of the lake and the <br />recreational users of the lake. <br /> <br />Molly Shodeen, area hydrologist from the DNR, inspected the fence on October 31, 2001 <br />I <br />(attachment # D. Her comment was "How tragic. It does represent a visual intrusion." <br /> <br />John Lincstinc, also a hydrologist from the DNR, says this fence obstructs the air movement <br />around the shoreline and provides ways to collect debris and by gravity going into the lake and <br />creating an inherent environmental problem to any lake. <br /> <br />Mr. Hoff applied for a residential building permit on April 16, 2001. My letter dated August 23, <br />2000 was not entered onto the record (attachment #1-). On July 1i\ a letter was sent to Mike <br />Barack, City of Roseville Building Inspector, asking that construction be halted until there was <br />building code approval. The City Building Inspector also asked Mr. Hoff to stop construction on <br />August 14,2001 (attachment # (.I). This letter said the fence does not meet code and remedial <br />action must be taken. Nothing has been done. <br />
