As I explained to
you, the shoreland ordinances statewide are silent on calling fences structures due to the fact that
people want to protect small children and confine livestock in the outstate areas. Communities can
be more restrictive and often have fence standards in their local codes. The state building code also
offers some standards on when fences require permits. In this case the white plastic fence does not
seem to be safety related, so I would think that the owner would have difficulty showing hardship
for the issuance ofa variance to the city's standards.

Some communities do try to regulate structures that cause aesthetic concerns on lakes. Clearly, if
one drives around the lake, there are no other such structures, and it does represent a visual intrusion
from my point of view. However, the shoreland regulations do not have any authority to regulate
such things unless the local government wishes to amend their shoreland ordinance. I have included
some pages from the city of Shore view's ordinance. The DNR frequently receives complaints and
questions about fences, and only when there is a safety issue for lake users does the water safety
patrol get involved.

If you have any further questions, please contact me at 772-7915.

Sincerely,

1\ ~ll \~~ ()ct~

Molly Shodeen
Area Hydrologist

c:

City of Roseville, Tom Paschke

"l .'---
t\ I
" \

____ if-
f iI, I J lei (- (<~) I ! j
} 'j\"----- '\ "--' fU

DNR Infonnation: 651-296-6157 · 1-888-646-6367 .
