July 12, 2001

~;<~

Mike Barck
Building Inspector
City of Roseville
2660 Civic Center Drive
RoseviIIe, MN 55113

Dear Mike:

Brad Hoff, 1897 Shady Beach Avenue, Permit AOI-282 (attached) does not meet city code and
must halt construction under his building permit.

Tom Paschke of your city says the permit does not meet the RoseviIIe city building code. From
Hoffs house to McCarrons Lake to the shoreline, the fence must be not more than 72". The plan
shows 78". From Hoffs house to Shady Beach Avenue, the code is not more than 48"; the plan
shows 78". The permit says "This plan was approved by the City of RoseviIIe in 1990 and all
adjoining neighbors signed this plan." We have been on record (attached) in June 2000 objecting
to his fence. Frank Hess at 1897 Shady Beach Avenue (attached), the other neighbor, never
approved any plan and is also objecting to the height and setbacks.

The proposed fence is lying on the ground and is a white plastic vinyl. No human being would
build a fence for a Labrador out of this material. This will create a visual eye sore for the entire
neighborhood. We need to know who is to maintain this neighborhood blight and at what level it
is to be maintained and how it is to be quantitatively measured. This new fence will decrease my
property value. It is a 'taking' without due process.

We are asking for a 30-day building moratorium on building permit AOI-282, a copy of which is
attached and a halt to present construction. Further, we are asking that a new building permit be
issued which conforms to the city code and that it be circulated in the neighborhood for approval.

Thank you for your consideration.

a~,

Daniel M.
