<br />Community Development Department <br />651-490-2279 . fax: 651-490-2931 <br /> <br />August 14,2001 <br /> <br />Mr. Brad Hoff <br />1897 Shady Beach Avenue <br />Roseville, MN 55113 <br /> <br />RE: Installatioll of llOll-collformillg fellce. <br /> <br />Dear Mr. Hoff: <br /> <br />On April 27, 2001, the City of Roseville issued a building permit to allow the installation of a <br />vinyl fence along the northwestern property line of your property. The site plan that you <br />submitted with your pern1it application was in error and did not depict the City Code allowances <br />for yard fencing. Specifically, a fence located I a side or rear yard can be no taller than 6 feet 6 <br />inches and a fence in a front yard can be no taller than four feet tall. <br /> <br />The issuance of a permit requires the verification of the property line by either exposing the <br />property corner pins or by provision of a registered survey. <br /> <br />During the installation, the City's residential building inspector notified you that the fence did <br />not meet the City Code and installation must stop until corrected. You proceeded to contact <br />Dennis Welsch, Community Development Director, and me regarding the fence height <br />allowance in the front yard, claiming that the City previously approved a taller fence on the <br />property. However, we found no such records and detennined that the fence must be no taller <br />than four feet in height in the front yard. We also determined that the fence could be constructed <br />to the shoreline of Lake McCarrons, but must be no taller than six feet six inches in height. <br /> <br />Recently, the Community Development Department has determined that the installation of the <br />fence was not completed in accordance with the City Code. In so doing, the fence installed in <br />the front yard is in direct violation of City Code, Section 10 12.02B2 and 3 of the Roseville City <br />Code. <br /> <br />The Community development Staff has determined the following: <br /> <br />II The terrain (slope) of the lot from Shady Beach A venue to the lakeshore will contribute <br />to an uneven fence installation that may be taller than the maximum required height of <br />six feet six inches. This situation is acceptable if the fence located on the high side of the <br />slope meets the six foot six inch maximum requirement. The City will inspect and verify <br />the fence height for conforn1ity to Section 10 12.02B3 of the Roseville City Code. <br />
