Welsch <br />Community Development Director <br />City of Roseville <br />2660 Civic Center Drive <br />Roseville, MN 55113 <br /> <br />Re: Joel Cheney <br />Setback Permit Approval <br />Appeal <br /> <br />Dear Mr. Welsch, <br /> <br />I am in receipt of your letter dated May 9, 2001, directed to Mr. Cheney, wherein <br />you approved his setback permit. <br /> <br />In accordance with telephone directions from Mr. Thomas Paschke, and <br />Roseville Ordinance No. 1225, Section 5, Paragraph 11, please accept this letter as my <br />appeal of the setback permit approval. My appeal will be based on, among other things: <br />1) the inability of the Community Director to approve the setback permit without the <br />unanimous consent of all contiguous property owners; 2) applicant's failure to meet, and <br />the Development Review Committee's error in agreeing that the applicant had met, the <br />required number of site conditions; and, 3) the Development Review Committee's and <br />the Community Development Director's arbitrary and capricious approval of a change to <br />existing code requirements. <br /> <br />Mr. Paschke has informed me that a fee is not required to bring an appeal. This <br />is in contradiction to your statement to me this morning.
