<br /> <br />Community Development Department <br /> <br />May 9, 2001 <br /> <br />Mr. Joel Cheney, <br />5506 Jenni Lane <br />White Bear Lake, Mn. 55110 <br /> <br />Re: Setback Permit, 2160 (approximate) Acorn Road <br /> <br />Dear Mr. Cheney: <br /> <br />On May 3, 2001 the City of Roseville Development Review Committee <br />(DRC) held a hearing on your request to encroach 4 feet into the north (rear <br />yard) setback and 4 feet into the west (street side) setback at the property <br />listed above. The DRC recommended approval of the setback permit for the <br />unique placement of your structure on the site. The purpose of this letter is to <br />inform you that I have concurred with the reasoning set forth by the DRC <br />and have approved the Setback Permit. <br /> <br />While there are some engineering and building construction issues related to <br />drainage, those issue are solvable and will be addressed in the building <br />permit process. This case is similar in many respects to the very first Setback <br />Permit issued by the City -a case of a new home on Belair Court in which a <br />large home needed some relief (front and rear setbacks) because of the <br />uniqueness of the site, tree preservation, grading, and drainage. <br /> <br />In your case, in addition to agreeing with the 5 applicable criteria cited by <br />the DRC, I have found there are issues relating to house placement on the <br />site. The four foot setback difference allowed by a setback permit preserves <br />the more highly valued oaks and conifers on the site; whereas a standard <br />building permit, with standard setbacks, has no control over this issue. In <br />addition, this permit help answer the two sections of the code which are at <br />odds regarding "front" (County Road B) of lot and preferred street (Acorn) <br />for a driveway. <br /> <br />2660 Civic Center Drive .:.
