Mr. Letendre has told Thomas Paschke that he will be/has <br />withdrawn his appeal. There apparently will be no hearing on Letendre's appeal. A written <br />appeal must be received within 10 days of approval of the permit. The hearing was set for <br />June 11 because the code states that an appeal goes to City Council within 30 days of the <br />appeal submission. The closest staff could get (extend) to 30 days was June 11th. The <br />staff (including me) does not set these meeting dates; they are set by the City Council at <br />the beginning of each year. These dates are rarely, if ever, changed by the Council simply <br />for setback appeals. The City Attorney did attend the hearing you mentioned. <br /> <br />In regards to the 4 foot setback, the plan incorrectly listed the edge of the deck or <br />overhang as part of the building's setback encroachment. Thomas Paschke correctly <br />identified the mistake by Cheney at the meeting. By code the setback is measured from the <br />principle structure wall, thus, instead of needing 6 feet, Cheney needed 4 feet. <br /> <br />Members of the city engineering staff did review the project and attend the meeting and <br />were the same staff who redesigned Acorn Road. They are fully aware of the topography, <br />drainage, and site lines at Acorn and County Road B. <br /> <br />In regards to house size, I do not feel a 1.5 story house with a walkout lower level is <br />out of context.
