<br />1 Metropolitan Council Transit Operations (MCTO). The rights hereby granted are not <br />2 exclusive and the City may grant like rights and responsibilities to other persons during <br />3 the term of this franchise, subject to the provisions of Section 703.05 ofthe City Code <br />4 regarding number and placements of such shelters, and locations as identified in <br />5 Appendix A. <br /> <br />6 Section 9. Notices. <br /> <br />7 All notices from Company to the City pursuant to this franchise shall be to the Director of <br />8 the Department of Public Works unless otherwise stated herein. The Company shall <br />9 maintain throughout the term of this franchise a local office and address for service of <br />10 notices by mail. The Company shall also maintain with the City a local office and <br />11 telephone number for the conduct of matters related to this franchise open during normal <br />12 transit hours. <br /> <br />13 Section 10. Basic Service and Installation Schedule. <br /> <br />14 The Company shall furnish, install, repair and maintain safe, clean and attractive <br />15 illuminated transit shelters with revenue generating advertisements in compliance with <br />16 this Agreement. In connection therewith, the Company shall provide all materials, <br />17 supplies, equipment, services and personnel at it sole cost and expense without any cost <br />18 or expense to the City. All transit shelters shall: (i) be installed within one hundred <br />19 eighty (180) days of the City's issuance of the applicable permits and licenses, (ii) be <br />20 erected in order of panel advertisement sales, (iii) contain lighting to illuminate the inner <br />21 area of each shelter from dusk to dawn; and (iv) be equipped with one bench and one <br />22 trash receptacle to be emptied on a regular basis by the Company. The design of the <br />23 transit shelters, the landscape plan and site plan with improvements therein shall be <br />24 submitted to and approved by the Public Works Director prior to construction as per <br />25 Section 703.05 of the City Code. The Company shall provide the Basic Services for the <br />26 sites specified in Appendix A by July 1, 200_. <br /> <br />27 Section 11. Maintenance. <br /> <br />28 The Company will maintain all shelters to the reasonable satisfaction of the Director of <br />29 Public Works as set out below. The transit shelters shall be maintained a minimum of <br />30 twice weekly with such maintenance to include sweeping, cleaning, emptying trash <br />31 receptacles, picking-up litter/debris about the shelter, removing graffiti/stickers, removal <br />32 of ice and snow from sidewalks and the shelter from the sidewalk to the curb in a manner <br />33 such that each shelter shall be fully accessible within 12 hours of a snow fall or other <br />34 weather event.. The Company shall power-wash the shelters and sidewalks at least once <br />35 each month, weather permitting. <br /> <br />36 The Company shall inspect each shelter at least twice weekly for any damaged or broken <br />37 parts or burned-out lighting fixtures and the Company shall repair or replace damaged or <br />38 broken parts and burned-out lighting fixtures within forty-eight (48) hours after the <br /> <br />3 <br />
