<br />1 Company becomes aware of the damage, breakage, or burn-out, or at the time of weekly <br />2 maintenance, whichever is sooner. <br /> <br />3 Section 12. Advertising. <br /> <br />4 Advertising size and placement shall be in accordance with the Roseville City Code <br />5 regulations. <br /> <br />6 Each transit shelter installed by the Company shall contain two panels for advertising <br />7 displays measuring no more than 48" wide and 72" high either positioned in form a <br />8 triangle or placed back-to-back on one-way streets. Where the sidewalk is detached and <br />9 is situated behind the shelter, a third panel will be added on the back of the triangle for <br />10 the City's use for public service announcements. Such displays shall be used solely for <br />11 advertising materials and/or public service announcements. The Company shall use its <br />12 best reasonable efforts to obtain revenue-generating advertisements for the two (2) <br />13 advertising display panels that face the street on each transit shelter, except where the <br />14 City has the right to utilize a panel for public service announcements. <br />15 <br />16 Except with respect to the monthly fee payable to the City pursuant to Section 10 hereof, <br />17 the Company shall have the right to retain all revenues generated from the advertising <br />18 displays on all transit shelters. Under no circumstances shall any advertising display <br />19 contain indecent or vulgar pictures, graphics or language or include advertising for any <br />20 alcohol or tobacco products. The Company further agrees not to display advertising <br />21 relating to contraception, pornography, politics or religion. The Company agrees to <br />22 remove within forty-eight (48) hours after its receipt of the City's written notification <br />23 requesting such removal, any advertisements which the City in its reasonable discretion <br />24 deems to be offensive, or in conflict with the City's health, safety and welfare concerns. <br />25 In the event that the Company fails to remove such advertisements within such forty- <br />26 eight (48) hour period, the City may remove the materials at the Company's sole cost and <br />27 expense. <br /> <br />28 Section 13. Locations. <br /> <br />29 Location of Transit Shelters: The Company shall erect transit shelters at those locations <br />30 that are mutually agreed upon by the City and the Company, but only after a permit is <br />31 approved by the Public Works Director as per Section 703.05 of the City Code. All <br />32 transit shelters shall be erected on public rights-of-way, or private property with written <br />33 authorization from the property owner(s), and shall be subject to all rules, regulations and <br />34 ordinances governing the use of such rights-of-way. Prior to erecting any such shelters at <br />35 any locations, Outdoor Promotions shall secure any necessary approval and/or zoning <br />36 variance that may be required from any governmental entity. <br /> <br />4 <br />
