<br />4.0 BACKGROUND: <br /> <br />4.1 Section 1012.09A states: the City Council may authorize an interim use permit of <br />property. Interim use may not be consistent with the land uses designated on the adopted <br />Land Use Plan. They may also fail to meet all of the zoning standards established for the <br />district within which it is located. <br /> <br />4.2 Section 1012.09B states: the City Council may attach conditions to interim use permits. <br />In reviewing interim use permit applications, the City will establish a specific date or <br />event that will terminate the use on the property. The Council will also determine that the <br />approval of the interim use would not result in adverse effects on the public health, safety <br />and general welfare, and that it will not impose additional costs on the public if it is <br />necessary for the public to take the property in the future. <br /> <br />4.3 Family Academy Charter School has seen a steady increase in enrollment since 2000 and <br />has determined that there is a need for a special education in the community. Further, <br />Family Academy is interested in piloting a program for preschool children who are hard <br />of hearing or deaf. <br /> <br />4.4 In July of2000, Family Academy received an Interim Use Permit to place a 72 foot by <br />126 foot modular classroom building in the parking lot east of the church/school. In <br />October of200l, the modular classroom was modified to a 12 foot by 56 foot modular <br />office located adjacent (east) of the school/church, which has been placed on the site and <br />has an expiration date of September 24, 2004. <br /> <br />5.0 STAFF COMMENTS/FINDINGS: <br /> <br />5.1 Family Academy has experienced steady student enrollment increases since 2000 and has <br />in interest in offering additional programs. They have determined a need for four <br />additional classrooms outside of the existing (limited) classroom space within Advent <br />Lutheran Church, and have proposed installing a 56 foot by 72 foot (two units - 4,032 sq. <br />ft.) modular classroom building on the south side of the school portion ofthe church. <br /> <br />5.2 The four classroom modular structure would house 6t\ ih, and 8th grade children; the <br />units, attached to create one large classroom setting, would be sited in close proximity to <br />the building entry; include skirting around the base; be handicapped accessible (ramped); <br />and would not obstruct or eliminate on-site parking. <br /> <br />5.3 The proposed placement of the modular classroom structure south of the school on the <br />grass will result in no loss of on-site parking, nor will the proposed use hamper on-site <br />traffic movements. Roof drainage from the modular classroom must be directed south or <br />east, away from existing buildings onto the grass. <br /> <br />5.4 The proposed interim use of the property for temporary classrooms will have a minimal <br />impact on on-site parking (increased demand for teachers and parents) and traffic in the <br /> <br />PF3392 - ReA 061702 - Page 2 of 5 <br />
