<br />SHED: The property setbacks changed in 1995 with the approved PUD. Previous to the <br />PUD approval the property was not considered a comer lot, and had a 5 foot side yard <br />setback; after the PUD approval this setback increased to 30 feet due to the dedication of <br />a new public street. The placement of the shed on the driveway is an acceptable location, <br />but the shed cannot meet the imposed (1995) setback from the new public road. <br /> <br />DRlVEW A Y: Once a driveway is installed it becomes difficult and costly to reduce its <br />size if, in fact, it must be reduced to meet the City Code. The sidewalk and driveway <br />replacement and expansion of this property appears to be over the maximum allowed by <br />Section 1004.01A6 of the Code. <br /> <br />B. The plight of the landowner is due to circumstances unique to the property not <br />created by the landowner: <br /> <br />The Community Development Staff has determined that the plight of the landowner <br />is due to circumstances unique to the property not created by the landowner. <br />Specifically: <br /> <br /> <br />The change in use of the lot to the east from a standard non-comer residentially zoned <br />property to a comer lot with a public right-of-way imposed a greater required setback <br />than previously required. Although the property owner was aware of this action, he may <br />not have been aware of a change in setback requirements on the property. The contractor <br />was responsible for submitting the permit application with accurate information for <br />review and approval, and abiding by all ordinance requirements. <br /> <br /> <br />C. The variance, ifgranted, will not alter the essential character of the locality: <br /> <br />The Community Development Staff has determined that this variance, if granted, <br />will not alter the essential character of the locality, nor adversely affect the public <br />health, safety, or general welfare, of the city or adjacent properties. <br /> <br />7.0 STAFF RECOMMENDATION: <br /> <br />7.1 Based on the information provided and the findings in Section 5 of this project report, the <br />Community Development Department recommends approval of a variance to Section <br />1004.02D4 and Section 1004.01A6 of the Roseville City Code for property located at 716 <br />County Road "C", subject to the following conditions: <br /> <br />A The shed being screened with a year round landscaping on the south and a portion <br />of the east of the property directly adjacent said shed. <br /> <br />B The applicant submitting and receiving a permit for the driveway work completed <br />consistent with the approved variance. <br /> <br />C The applicant submitting and receiving a permit for the garden shed, consistent <br />with the approved variance. <br /> <br />PF3393 - ReA 081902 - Page 4 of 5 <br />
