B. The plight of the land owner is due to circumstances unique to the property not
created by the land owner: The Vazquez home is unique due to odd setback. The
home is the only structure on the block and one of few city-wide that is setback
25 feet or less from a front property line. The Community Development Staff
does not look upon this variance as being created by the property owner, but
rather a valid living space addition that has no alternative.

C. The variance, if granted, will not alter the essential character of the locality:
Many homes from the 1940's were constructed with front porches; however, very
few exist in Roseville. The Community Development Staff has determined
that the design of the porch will not be out of character or context for a home
built in the 1940's. Further, staff has determined that the proposal would
not alter the essential character or the locality, nor adversely affect the
public health, safety, or general welfare, of the city or adjacent properties.

6.0 STAFF RECOMMENDATION:

6.1 Based on the information provided and the findings in Section 5 of this project report,
staff recommends approval ofa 7.5 foot variance from Section 1004.04D5 of the
Roseville City Code for Richard Vazquez to allow the construction a 8 foot covered
porch on the front of the home at 812 Lovell Avenue, subject to the following conditions:

a. The applicant submitting a site plan with the exact measurement the principal
structure lies from the front property line, which will require locating the front
property corner pins.

b. The variance not exceeding the dimensions indicated on the submitted site plans
or a three foot encroachment from the porch foundation (based on staff analysis
this would equal a 7.5 foot variance).

c. The review and approval of a building permit consistent with the approved
variance and plans.

d. The installation of roof gutters to properly direct roof drainage away from the
adjacent properties.

7.0 SUGGESTED PLANNING COMMISSION ACTION:

7.1 By motion, recommend approval (approval with modifications or denial) of a 7.5 foot
variance from Section 1004.04D5 of the Roseville City Code for Richard Vazquez, to
allow construction of a covered porch onto the existing principal structure at 812
Lovell Avenue, to within 22.5 feet of the front property line, based on the findings of
Section 5 and conditions of Section 6 of the project report dated June 5, 2002.

Prepared by: Thomas Paschke (490-2236)
Attachments: Location map, narrative, site plan, and aerial photo.

PF3396 - RPCA 060502 - Page 3 of 3
