Dear Mr. Vazquez: Thank you for the recent Setback Permit application regarding a porch addition onto the front of your home at 812 Lovell Avenue. I have reviewed the application and the City Code as it pertains to your property and have determined that the Setback Permit is not the proper process for your request. The setback permit process affords a property owner an encroachment of 20% or no more than a point 24 feet from a front or rear property line. Given your proposal to encroach three additional feet into the front yard (22-1/2 feet from the front property line), a variance would be the appropriate process. I am mailing back your setback permit application and check, and enclosing a variance application for you to complete should your desire to pursue the proposed porch. Please complete the application and submit the required information with the applicable fee to my attention. The variance process is a formal process for which a public hearing before the Planning Commission is necessary with a recommendation and a decision (approval/denial) made by the City Council. Upon submittal of your application, I will determine completeness and set the hearing date. The variance process takes between 45 and 60.days depending on the submittal cycle. The deadline for the June 5, 2002, Planning Commission meeting Wednesday, May 1,2002, however I will extend the deadline for your request to Friday, May 3, 2002.
