I have reviewed the application and the City Code as it <br />pertains to your property and have determined that the Setback Permit is not the proper process <br />for your request. <br /> <br />The setback permit process affords a property owner an encroachment of 20% or no more than a <br />point 24 feet from a front or rear property line. Given your proposal to encroach three additional <br />feet into the front yard (22-1/2 feet from the front property line), a variance would be the <br />appropriate process. <br /> <br />I am mailing back your setback permit application and check, and enclosing a variance <br />application for you to complete should your desire to pursue the proposed porch. Please <br />complete the application and submit the required information with the applicable fee to my <br />attention. The variance process is a formal process for which a public hearing before the <br />Planning Commission is necessary with a recommendation and a decision (approval/denial) <br />made by the City Council. <br /> <br />Upon submittal of your application, I will determine completeness and set the hearing date. The <br />variance process takes between 45 and 60.days depending on the submittal cycle.
