<br />4.0 BACKGROUND: <br /> <br />4.1 Section 1004.02D5 of the Roseville City Code requires a front yard setback of 30 feet for <br />principal structures. The Vazquez home was constructed in 1946, prior to the adoption of <br />a zoning ordinance. This construction has now left the home 25.5 feet from the front <br />property line along Lovell Avenue. <br /> <br />4.2 The proposed porch would create a visual entry into the home, which has a very small <br />entry and no formal foyer. The proposed porch would be constructed to provide safe <br />maneuverability and a covered landing before entering the home. <br /> <br />4.3 Under staff interpretation of the City Code any extension of a principal structure that is <br />covered is an integral component of the principal structure. Therefore, a covered porch is <br />required to meet all required principal structure setback requirements, which on this <br />parcel is 30 feet. <br /> <br />5.0 STAFF COMMENTS/FINDINGS: <br /> <br />5.1 The Section 1013.02 requires the applicant to demonstrate a physical hardship and to <br />demonstrate that no practical alternatives exist that would reduce the need for a variance. <br />Variance may be granted where the strict enforcement of the literal provisions of the <br />ordinance would cause "undue hardship". The granting of a variance shall only occur <br />when it can be demonstrated that such an action will be in keeping with the spirit and <br />intent of the ordinance. <br /> <br />5.2 "Undue hardship" as used in connection with the granting a variance means the property <br />in question cannot be put to a reasonable use ifused under conditions allowed by the <br />official controls, the plight of the land owner is due to circumstances unique to the <br />property not created by the land owner, and the variance, if granted, will not alter the <br />essential character of the locality. Specifically to this request: <br /> <br />A. The property in question cannot be put to a reasonable use if used under <br />conditions allowed by the official controls: The Vazquez home was constructed <br />in 1946 prior to the City Code and has been determined to lie 25.5 feet from the <br />front yard property line. Research and records are inconclusive on whether a <br />small portion of the parcel at 812 Lovell Avenue was taken to construct the street. <br />The Community Development Staff has determined that safe access is an <br />important part of livability and it is reasonable to allow the construction of a <br />three-foot porch addition onto the existing front entry of the home. The <br />proposed porch will create useable living area to the home and a covered <br />entry area for guests to be protected from the weather. <br /> <br />PF3396 - ReA 060502 - Page 2 of 4 <br />
