<br />4.0 PROJECT SPECIFICS/FINDINGS: <br /> <br />4.1 The Wildlife Rehabilitation Center in conjunction with their new headquarters <br />development are requesting the vacation of a certain utility easement, which lies within <br />building limits. The proposal calls for a new utility easement to be established directly <br />adjacent (south) the current easement and for the existing utilities to be reconstructed <br />within said new easement. Based on the proposed plan and the provision of a utility <br />easement prior to the relocation of utilities, the existing easement area identified on the <br />attachment is no longer necessary. <br /> <br />4.2 Section 1013.04 outlines the procedure for vacating streets, alleys, and easements. A <br />public hearing is required. The Planning Commission holds the hearing and recommends <br />action on the vacation request to the City Council. <br /> <br />4.3 The Roseville Engineering Department has reviewed, provided comments, and with the <br />addition of a manhole, approved the proposed design and plans to relocate public <br />utilities. They have determined there is no change in the capacity of the utility services, <br />and only a minor addition to the flow. As-built drawings will be required upon <br />completion of the relocation. The Engineering Department has also determined the <br />proposed easement to be adequate to accommodate the reconstruction of the existing <br />utilities. All easement documents must be recorded prior to the issuance of a certificate of <br />occupancy for the new building on the site. <br /> <br />4.4 The applicant (Wildlife Rehabilitation Center) is responsible for the full cost of vacating, <br />moving, and reconstructing the sanitary sewer and the easement it lies within. <br /> <br />4.5 The applicant must submit a utility plan and the utility easement document and legal <br />description for the easement to the Engineering Department. The City must release the <br />existing utility easement upon the recording of the new utility easement. <br /> <br />5.0 POLICY & FISCAL IMPLICATION <br /> <br />5.1 There are no additional fiscal implications for the City of Roseville. All modifications to <br />be the responsibility of the developer (Wildlife Rehab Center). <br /> <br />6.0 STAFF RECOMMENDATION: <br /> <br />6.1 The Community Development Staff recommends approval of the request by the Wildlife <br />Rehabilitation Center for the vacation of a certain utility easement, acceptance of a new <br />replacement easement, and the relocation of a portion of a sanitary sewer, all located in <br />the parking lot at 2530 Dale Street. <br /> <br />PF3403 RPCA 060502 Page 2 of 3 <br />
