B. <br />Manager APJ2Jov~:_ , Agenda Section: <br />~ CONSENT <br />escription: Establish Hearing Date for Property Abatement <br /> <br /> <br />1.0 BACKGROUND <br /> <br />1.1 Periodically the Community Development staff reviews Code violations relating <br />to property maintenance to determine whether there are properties in disrepair <br />for extended periods. The staff spends time attempting to gain voluntary <br />compliance during the year on these properties. Generally, they have not met the <br />Code because the owner has been unable (physically or financially) or unwilling <br />to comply with the Code. Property abatement is one remedy. It allows the City <br />to order corrections and assess the property for the work. This process has been <br />used in previous years to secure buildings from vandals and weather, clean up <br />buildings, paint and/ or restore siding, plug rodent holes, repair windows, and <br />fix failing garage roofs and doors. <br /> <br />1.2 The staff attempts to work with property owners to bring the structure into <br />compliance (and continues to encourage property owners to repair properties up <br />to the time of a Council hearing). The hearing is an opportunity for the property <br />owners to address the property repair issues, estimated costs of repair, and <br />suggest alternatives to the abatement process. The process is attached. <br /> <br />1.3 The City goals within the comprehensive plan are to protect and improve <br />property values (Goals 3, 4 and 5; page 6 and 7, Section 3) and to adhere to <br />performance standards, which protect the integrity of commercial areas and <br />neighborhoods (Policy 6, page 8, Section 3). <br /> <br />1.4 If a hearing date is approved, the property would be scheduled for an abatement <br />hearing on June 10,2002. The property owner will be given a 30-day notice of <br />the proposed hearing. The property has been reviewed and an exterior <br />inspection completed. An estimate of the cost of corrective actions has been <br />prepared. <br /> <br />2.0 STAFF RECOMMENDATION <br /> <br />2.1 Staff recommends establishing a property abatement hearing for June 10,2002. <br /> <br />3.0 SUGGESTED COUNCIL ACTION <br /> <br />By resolution, establish June 10, 2002 as the hearing date for the property abatement <br />case. <br /> <br />1 <br />
