<br />4.0 REVIEW of REQUEST: <br /> <br />4.1 Section 1009.04A2 states: "One nameplate sign for each dwelling unit group above 24 units which <br />shall not exceed 1 square foot per unit to a maximum of 100 square feet in area. Such nameplate <br />sign may be attached to the wall of a building or may be freestanding. In no case shall more than <br />one sign be allowed for each dwelling group. All such signs shall conform to setback <br />requirements of the code." <br /> <br />4.2 Section 1009.03M (Ground Signs) requires ground signs to no greater than 8 feet in height and <br />that they are allowed to be set back from a property line 12 the distance of a pylon sign but not less <br />than 15 feet. <br /> <br />4.3 Mr. Stock has submitted a proposal to install a 4 foot by 6 foot V-shaped sign (48 total square feet) <br />in the front yard of the Sunrise Assisted Living parcel, to be located at or near the property line <br />adjacent to Snelling Avenue on the northern portion of the site. <br /> <br />4.4 Sunrise Assisted Living has provided a letter to the City indicating their support of the request by <br />Mr. Stock. <br /> <br />4.5 Sunrise Assisted Living was approved as a Planned Unit Development in 2000, which plan and <br />agreement made no specific reference to the number, type, size, or style of signage to be installed <br />on the premises. <br /> <br />4.6 The City Attorney has reviewed the City Code (Signage) and the Planned Unit Development <br />Agreement, concluding that Mr. Stock can apply for and proceed through the variance process. <br /> <br />5.0 STAFF COMMENTS/FINDINGS: <br /> <br />5.1 The Press Gym is located at 2560 Fry Street directly west ofthe Sunrise facility. Prior to the <br />redevelopment of the property at 2555 Snelling Avenue, the Sunrise parcel was occupied by the <br />Knights of Columbus and allowed visual access\views to the west from Snelling A venue. Upon <br />the completion of the Sunrise structure (3 story, V -shaped facility) the view through the Sunrise <br />site to the Press Gym became obstructed by the building. <br /> <br />5.2 Mr. Stock has been working with the City to determine what options exist to provide him signage <br />from Snelling Avenue. Specifically, the Community Development Department completed a <br />review of the signage code last year concluding that off site signage was not permissible and <br />directed Mr. Stock to work with the Park & Recreation Department on a joint sign for his business <br />and Rosebrook Park. However, the joint sign never gained the support necessary to proceed with a <br />proposal. <br /> <br />5.3 In May/June of2003, the City Planner requested the City Attorney review the sign code to <br />determine whether off site signage would be permissible and if so, would it be permissible on the <br />Sunrise parcel. The Attorney concluded through a review of the Code and the Sunrise PUD <br />Agreement that a variance was necessary to support a second sign on the Sunrise parcel. <br /> <br />5.4 Mr. Stock has indicated in his narrative that the Press Gym is highly reliant on drive-by visibility <br />for survival and that the Sunrise facility and a privacy fence along the north property line adjacent <br />the west parking lot obstructs visibility completely from Snelling Avenue and limits visibility from <br /> <br />PF3502 - RPCA 080603 - Page 2 of 4 <br />
