<br />4.0 REVIEW of REQUEST: <br /> <br />4.1 Section 1004.0 IE (Exception) reads: "If after May 21, 1959, existing houses on 50% or <br />more of the frontage of any block have a predominant front yard different from that <br />herein specified, all buildings hereafter erected shall conform to this predominant front <br />yard depth, provided this regulation shall not be interpreted so as to require a front yard <br />on more than 40 feet in depth. <br /> <br />4.2 The City Planner has determined that the Paal home was constructed in 1955 and has a <br />predominant setback of 44 feet. The proposal to construct an attached garage that extends <br />20 feet into the predominant front yard setback requires a variance of the same distance to <br />allow the principal structure to within 24 feet of the front yard property line <br /> <br />4.3 The Paal parcel is somewhat pie shaped being wider at the right-of-way line and narrower <br />at the rear. This design and the generous front yard setback create limited options for the <br />Paals to add a double stall garage and more living area on to their home and create <br />angular setbacks along the west and east property lines. <br /> <br />4.4 Section 1004.02D5 (Dwelling Dimensions - Side Yard Setback) requires all principal <br />structures to be setback a minimum of 5 feet from a side yard property line. The Paal <br />home is currently set back 7 feet 6 inches from the side (east) property line. <br /> <br />4.5 The proposal by James Paal seeks to encroach 6 inches into the required side yard <br />setback at the rear portion of the addition. The front portion of the addition would be set <br />back 6 feet from the side yard property line. <br /> <br />4.6 The current home has a footprint of approximately 1,680 square feet, including the <br />existing attached 280 square foot (14 foot by 20 foot) garage, and hard surface (stoop, <br />patio, and driveway) area of approximately 1000 square feet.
