<br />WHEREAS, the Roseville Planning Commission held the public hearing regarding the <br />Vicorp Inc., (Rick Foerster) variance request (Section 1005.01A2) on August 6,2003, and <br />recommended (5-0) approval of the request based on findings outlined in Section 5 and <br />conditions of Section 7 of the project report dated August 6, 2003. <br /> <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant Vicorp <br />Inc. (Rick Foerster) a 5 foot 2 inch VARIANCE to Section 1005.01A2 (Side Yard Setback) of <br />the Roseville City Code allowing the construction of a uni-sex restroom in compliance to <br />Minnesota Accessibility Codes to a point 4 feet 10 inches from the east property line for property <br />located at 1881 Highway 36 West subject to the following conditions: <br /> <br />1. The side yard setback being established at 4 feet 10 inches, which distance allows <br />for a 5 foot 2 inch 5 feet by 15 feet (75 sq. ft.) addition on to the east side of the <br />principal structure. <br /> <br />2. The review and approval of a building permit must be consistent with the <br />approved plans and variances. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Maschka and upon vote being taken thereon, the following voted in favor: Klausing, <br />Schroeder, Kough, Maschka, and Kysylyczyn; <br />and the following voted against: None <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br /> <br />2 <br />
