<br /> <br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 26th day of January 2004, at 6:30 p.m. <br /> <br />The following members were present: Klausing, Kough, Maschka, and Schroeder <br /> <br />and the following were absent: None <br /> <br />introduced the following resolution and moved its adoption: <br /> <br />Council Member <br /> <br />RESOLUTION NO. <br />A RESOLUTION DENYING A CONDITIONAL USE PERMIT IN ACCORDANCE <br />WITH SECTION 1005.04C17 AND 10B.01D OF THE ROSEVILLE CITY CODE FOR <br />SPEEDWAY SUPERAMERICA, 2172 LEXINGTON AVENUE (PF3524). <br /> <br />WHEREAS, Speedway SuperAmerica has requested a Conditional Use Pel111it in <br />accordance with Section 1005.04C17 and 1013.0lD of the Roseville City Code to allow a 2,200 <br />sq. ft. off-sale liquor store within the existing convenience store; and <br /> <br />WHEREAS, the Speedway SuperAmerica parcel is located at 2172 Lexington Avenue, <br />and legally described as: <br /> <br />Requires Correct Legal Description <br />PIN: 11-29-23-33-0065 <br /> <br />WHEREAS, Section 1013 establishes the criteria for reviewing conditional use permits, <br />which is as follows: <br /> <br />a. Impact on traffic <br />b. Impacts on parks, streets and other public facilities <br />c. Compatibility of the site plan, internal circulation, landscaping and structure <br />with contiguous properties <br />d. Impact of the use on market value of contiguous properties <br />e. Impact on the general public health, safety and welfare <br />f. Compatibility with the City's Comprehensive Plan <br /> <br />WHERAS, the Roseville Planning Commission held the public hearing on the <br />Conditional Use Permit for SuperAmerica finding the following: <br /> <br />a. that the proposed request/project will impact traffic for the following <br />reasons: There will be a 3.5% increase in traffic. However, there is no <br />information available regarding traffic accidents in the area and there may <br />be a public service impact. <br /> <br />1 <br />
