<br />1 A. Setback Requirements shall be as established in the above chart (Section 1005.01) unless specified <br />2 differently in this subsection: <br />3 1. Front Yard Setback: Where adjacent structures have front yard setbacks different from those required, the <br />4 front yard setback shall conform to the average setback of the adjacent structures. If only one adjacent lot is <br />5 occupied by a structure, the front yard setback shall be the average of the required setback and the setback <br />6 of that adjacent structure. (Ord. 275, 5-12-1959) <br />7 2. Side Yard Setback:. When a side yard adjoins a residential district, the setback shall not be used for <br />8 parking or loading. Where a side yard faces a street (comer lot), the side yard setback shall be thirty feet <br />9 (30'). Where such a comer lot side yard faces a residential district across the street, screening shall be <br />10 provided as specified in subsection G of this Section. (Ord. 878, 3-23-1981) <br />11 3. Rear Yard Setback; Screen Wall. Where the rear yard adjoins a residential distIict, a screen wall of six <br />12 feet (6') but not more than eight feet (8') in height shall be installed and maintained by the owner of the <br />13 business parcel to effectively inhibit eye level vision between residential and business areas. <br />14 B. Floor Area Ratio: Subject to all other provisions ofthe code and setbacks, the floor area of <br />15 building and lot area in all business districts shall not be greater than 1.0. See Section 1005.01. <br />16 (Ord. 275, 5-12-1959) <br />17 C. Building Height: See Section 1005.01 and 1005.02C <br />18 D. Off-Street Parking: See Section 1018 <br />19 E.. Enclosure Of Certain Businesses Required: <br />20 1. All business, storage, service, repair, processing or merchandising display shall be conducted wholly <br />21 within a building or behind a solid fence not less than six and one half feet (6' - 6") or nor more than eight <br />22 feet (8') high adjacent to residential districts to completely screen the activity or storage, except for the <br />23 following uses and in accordance with the conditions herein specified. <br />24 a. Off-street parking and loading where permitted as accessory uses. <br />25 b. Display of automobiles and trucks where accessory to authorized principal uses. (Ord. 1091, 5-28- <br />26 1991; amd. 1995 Code) <br />27 2. Temporary outside display and sale of merchandise outside a building or protective structure may be <br />28 established for up to thirty (30) consecutive calendar days a year after the issuance of a temporary <br />29 display/sales permit by the Community Development Director or designee, using the criteria set forth in <br />30 subsection 3 below in any of the following business districts where retail sales are allowed: B-2, B-3, B-4 <br />31 and shopping center districts. A single temporary display sign per tenant, not to exceed twenty (20) square <br />32 feet, within ten feet (10') of the sales area, and with property owner approval, may be placed on a wall or <br />33 solid surface for the thirty (30) day temporary sale. A site plan indicating the location of the sales area and <br />34 sign shall be provided to the city for review and approval. <br />35 3. Incidental or seasonal sales, such as produce, nursery, or greenhouse sales, including an accessory <br />36 structure may be permitted after issuance of a seasonal sales permit for a period not to exceed ninety (90) <br />37 calendar days, after review of the following criteria submitted with the permit application: <br />38 a. The amount of outside sales area compared to the amount of inside sales space. <br />39 b. Location of the outside sales area and the extent it encroaches on required setbacks. <br />40 c. Impact on traffic, pedestrian circulation, and emergency response on the site. <br />41 d. Impact on parking on the site. <br />42 e. The height of merchandise displays. <br />43 f. The hours which merchandise is displayed. <br />44 g. The type of merchandise to be displayed. <br />45 h. Incidental or seasonal display signage, to a maximum of seventy five (75) square feet in area, shall be <br />46 placed on a solid surface or attached to a solid surface for the term of the display. <br />47 i. Accessory structures used in incidental or seasonal displays shall meet all applicable fire codes and <br />48 parking lot setback requirements. (Ord. 1238,3-13-2000) <br />49 4. The outside display of merchandise, except as covered in subsections E1 E2, and E3 of this section, is <br />50 permitted by conditional use permit.
