<br />1 A. Setback Requirements shall be as established in the above chart (Section 1 005.0 I) unless specified <br />2 differently in this subsection: <br />3 I. Front Yard Setback: Front yard setback SHall be thirty feet (30') in all business districts. Where adjacent <br />4 structures have front yard setbacks different from those required, the front yard setback shall conform to the <br />5 average setback of the adjacent structures. If only one adjacent lot is occupied by a structure, the front yard <br />6 setback shall be the average of the required setback and the setback of that adjacent structure. (Ord. 27S, 5- <br />7 12-19S9) <br />8 2. Side Yard Setback: Side yard setback shall be a minimum of ten feet (10'). When a side yard adjoins a <br />9 residential district, the setback shall not be used for parking or loading. Where a side yard faces a street <br />10 (corner lot), the side yard setback shall be thirty feet (30'). Where such a corner lot side yard faces a <br />I I rcsidential district across the street, screening shall be provided as specified in subsection G lofthis <br />12 Section. (Ord. 878, 3-23- 1 981) <br />13 3. Rear Yard Setback; Screen Wall: Rear yard setback shall be a minimum of twenty feet (20'). Whcre thc <br />14 rear yard adjoins a residential district, a screen wall of not less tHan four feet ('1') and not greater tHan six <br />15 feet (6') but not more than eight feet (8') in height shall be installed and maintained by the owner of the <br />16 business parcel to effectively inhibit eye level vision between residential and business areas. <br />17 B. Floor Area Ratio: Subiect to all other provisions of the code and setbacks. the ratio bet,veen floor area of <br />18 building and lot area in all business districts shall not be greater than 1 .0. See Section 1 OOS.O l. (Ord. 27S, <br />19 5-12-l9S9) <br />20 C. Building Hcight: Building height in business districts shall be limited to three (3) storien, except in B 1 <br />21 ~. See Section lOOS.OI. and lOOS.02C. U;. wherein the follO\ving limitations shall apply: <br />22 'Nherc buildings are v,ithin one Hlclfldred fifty feet (1 SO') of a residential zone, such buildings shall be <br />23 limited to the average height of e)(isting residential buildings within one hundred fifty feet (1 SO') of a <br />24 proposed B 1 building. The City Council may grant a conditional use pennit for a building in a B 1 District <br />25 t& be a ma)[imum of three (3) stories upon application of a petitioner and holding of a publie hearing under <br />26 the procedures set forth in Chapter 108 of this Code. Upon granting sueh a conditional use pcrn1it, the City <br />27 Council may impose such conditions which may be appropriate to protect the public health, safety and <br />28 welfare. Convcnience Center, Supermarlcets, Drug Stores And Similar Retail Uses: Five (5) spaces per one <br />39 thousand (l,OOO) square feet of gross leasable area. <br />40 d. Shopping Centers Including Neighborhood, Community ,'.nd Regional Shopping Ccnters: Five (S) <br />41 spaces per one thousand (1,000) square feekH'-gross leasable area. <br />42 c. Banles, Savings & Loan Offices ,^.nd Other financial ,^.nd/Or Thrift :\gcncics: Six (6) spaccs per one <br />43 thousand (l ,000) square feet of gross floor area. (Ord. 801,3 l1 1977) <br />44 f. Theater, Other Than Drive In Type: One space per each three (3) seats. (Ord. 878, 3 23 1981) <br />45 g. Places Of Public ,'\ssembly Including Librarien, Museums, Auditoriums And Similar Uses: four and <br />46 one tenth (1. l) spaces per one thousand (l ,000) square feet of gross floor arca, or one space per thr.ee+J1 <br />47 seats in design capacity of all auditoriums or places of assembly, whichever is greater. <br />48 h.
