Temporary outside display and sale of merchandise witfloot outside a building or protective structure <br />2 may be established for up to thirty twelvo (12)(30) consecutive calendar days a year after the issuance of a <br />3 temporary display/sales permit by the chief code enforcement officer Community Development Director or <br />4 designee, using the criteria set forth in subsection 3 below in any of the following business districts where <br />5 retail sales are allowed: B-2, B-3, B-4 and shopping center districts. A single temporary display sign..Qg <br />6 tenant, not to exceed twenty (20) square feet, within ten feet (10') of the sales area, and with property owner <br />7 approval, may be placed on a wall or solid surface for the thirty tweJ.y.e (R30) day temporary sale. A site <br />8 plan indicating the location of the sales area and sign shall be provided to the city for review and approval. <br />9 3. Incidental or seasonal sales, such as produce, nursery, or greenhouse sales, including an accessory <br />10 structure may be permitted after issuance of a seasonal sales permit for a period not to exceed ninety (90) <br />11 calendar days, after review of the following criteria submitted with the permit application: <br />12 a. The amount of outside sales area compared to the amount of inside sales space. <br />13 b. Location of the outside sales area and the extent it encroaches on required setbacks. <br />14 c. lmpact on traffic" ana pedestrian circulation. and emergency response on the site. <br />15 d. Impact on parking on the site. <br />16 e. The height of merchandise displays. <br />17 f. The hours which merchandise is displayed. <br />18 g. The type of merchandise to be displayed. <br />19 h. Incidental or seasonal display signage, to a maximum of seventy five (75) square feet in area, shall be <br />20 placed on a solid surface or attached to a solid surface for the tenn of the display. <br />21 i. Accessory structures used in incidental or seasonal displays shall meet all applicable fire codes and <br />22 parking lot setback requirements. (Ord. 1238, 3- 1 3-2000) <br />23 4. The outside display of merchandise, except as covered in subsections GE 1 E2, and GE3;l, of this section, <br />24 is permitted by conditional use permit. When considering any such conditional use pemlit request, the <br />25 planning commission and city council shall consider the following criteria to determine the impact of the <br />26 proposed outside display on the site, adjacent properties and the community as a whole: <br />27 a. The amount of outside sales area compared to the amount of inside sales space. <br />28 b. Location of the outside sales area and the extent it encroaches on required setbacks. <br />29 c. lmpact on traffic antI-pedestrian circulation, and emergency response on the site. <br />30 d. Impact on parking on the site. <br />31 e. The height of merchandise displays. <br />32 f. The hours in which merchandise is displayed. <br />33 g. The type of merchandise to be displayed. <br />34 5. The issuance of a conditional use pem1it for the outside display of merchandise shall not cause <br />35 nonconforming sites to be brought into conformance with all code requirements, or the dedication of street <br />36 rights of way. Process And Equipment Limitations: Processes and equipment employed and goods processed or sold shall <br />38 be limited to those which are not objectionable by reason of odor, dust, smoke, cinders, gas, noise, <br />39 vibration, refuse matter or water-carried waste. <br />40 GJ. Buffer Zone Between Business And Residence District: Where a business district abuts a residence district, <br />41 any new development shall include a landscaped buffer zone. There shall be a protective strip ofland not <br />42 less than ten feet (10') in width. This protective strip shall contain no structures, shall not be used for <br />43 parking, off-street loading or storage. and shall be landscaped. The landscape treatment shall include a <br />44 compact screen wall or fence but shall not extend within fifteen feet (15') of the street right of way. The <br />45 planting or fence design must be approved by the city council Community Development Director or <br />46 designee as being in harmony with a residential neighborhood and providing sufficient screening of the <br />47 commercial area. The hedge or fence shall be no less than six feet (6') nor more than six and one half feet <br />48 ~ eight feet (8') in height. (Ord. 275, 5-l2-l959) <br />49 HJ-.
