<br /> <br />REQUEST FOR COUNCIL ACTION <br /> <br />Department Approval: <br />DPW <br />Item Description: <br /> <br />DATE: 02/09104 <br />ITEM NO: 3.9 <br />'-2 ,i "/) T2 n ff Agenda Section: <br />fUlL{ N-f/~ CONSENT <br />Amendment to text of Shopping Center Zoning Districts within City Code Section <br />1006 (PF3528) <br />(SECOND READING AND FINAL APPROV AL) <br /> <br />1.0 BACKGROUND: <br /> <br />1.1 The Planning Commission, Council and staff have been completing a systematic rewrite of <br />outdated portions of the City Code for three past three years. Attached is the draft of an <br />ordinance which would modify the Shopping Center Zoning District language and format. The <br />new format consolidates the dimensional requirements on one page and also consolidates the <br />land uses allowed in each district into one standard chart, similar to the work that was done <br />earlier for the Residential Zoning Text. Staff has reviewed this document and changes in the <br />past two years with the Chamber of Commerce and representatives from the shopping centers in <br />the area, who are interested in seeing the language updated to record that their properties are <br />legally conforming uses and structures. <br /> <br />1.2 One of the obvious amendment advantages is that it reduces the repetitiveness of the Shopping <br />Center Zoning text by consolidation. In addition, it allows users to view a comparison of what <br />other business (B-1 through B-6) districts uses might be allowed (or prohibited). No significant <br />changes have been made to the dimensional requirements. <br /> <br />1.3 This amendment, to Sections 1006.01 through 1006.05, if passed, would eliminate duplicated <br />text in this section of the code. It would also refine some of the land uses permitted by being <br />more specific than simply stating that uses allowed in a B-2 district are allowed in a shopping <br />center district. <br /> <br />1.4 Lot coverage has been eliminated in this proposal. Floor area ratio has been changed to "1.0", <br />which is equivalent to the B-3 zone. Building height is clarified as 3 stories above the main <br />level entry or 35 feet, except as approved in a master plan or a PUD. More clarity has been <br />provided in the 24 hour standards, regarding buffer, landscaping, loading, lighting, and snow <br />storage. <br /> <br />1.5 Staff has added the definition for the shopping center district section, providing a clearer <br />understanding of the uses which should be allowed therein, and recognized the site plans and <br />permits in effect as of January, 2000 as the "approved" plan from which all future amendments <br />will be calculated. <br /> <br />2.0 RECOMMENDATIONS: <br /> <br />On December 3,2003, the Planning Commission held a public hearing regarding the proposed <br />changes to the City Code pertaining to Shopping Center uses and reulations. The Commission <br />recommended approval of the draft ordinance dated December 3,2003 and attached.
