An expansion of a pre-existing residential principal or accessory structure in an R-1 or <br />2 R-2 zoning district which maintains the same property line setbacks and structure <br />3 separations provided there is no further encroachment of any non-conforming structural <br />4 dimension or increase in the non-conformity of use of the land. <br />5 <br />6 2. A pre-existing principal or accessory structure, including expansion thereof, in which a <br />7 property line setback dimension has been made revised and made substandard by eminent <br />8 domain or other formal public agency action. Such a structure shall be considered a <br />9 legally conforming structure. All future additions to the structure or use shall meet the <br />10 required setback (at that time) from the revised property or easement line. <br />11 <br /> <br />12 1011.03: DAMAGED NONCONFORMING STRUCTURE: <br /> <br />13 Any nonconforming structure damaged to an extent of not more than fifty percent (50%) of its <br />14 reproduction cost by fire, flood, explosion or other casualty may be reconstructed and used as <br />15 before if such reconstruction is completed within six (6) months of the casualty. If the damage to <br />16 the structure is greater than fifty percent (50%) of the replacement cost of the structure at the <br />17 time of loss, as determined by the City Council, the reconstruction shall be in accordance with <br />18 this Code. (Ord. 881, 6-1-81; amd. 1995 Code) <br /> <br />19 1011.04: DISCONTINUED NONCONFORMING USE: <br /> <br />20 Whenever a nonconforming use shall have been discontinued for a period of sHftwelve (612) <br />21 months, it shall not return to the original or any other use which is nonconforming. (Ord. 881, 6- <br />22 1-81) <br /> <br />23 1011.05: MAINTENANCE OF NONCONFORMING STRUCTURES: <br /> <br />24 Normal maintenance of a structure containing or which is a nonconforming use is permitted, <br />25 including necessary nonstructural repairs and incidental alterations which do not extend, expand <br />26 the foundation and/or building size, increase the building occupancy or parking demand, or <br />27 intensify the nonconformiflgity of the structure or use.
