<br />4.0 REVIEW of REQUEST: <br /> <br />4.1 Jim Badzinski has submitted a proposal to reconstruct an existing deck on to the <br />lakeshore side of the home at 381 South Owasso Boulevard South. The deck, a 16 foot <br />wide by 16 foot deep structure would replace and expand an existing deck, extending into <br />the Bluff Impact Zone. The City Code does not permit construction of structures within <br />the Bluff Impact Zone, a 30 foot wide area that begins at the top of a bluff and extending <br />landward 30 feet. Mr. Badzinski's principal structure is currently located 36 feet from <br />the Lake Owasso shoreline and a minimum of 14 feet from the top of bluff (within the <br />bluff impact zone). <br /> <br />4.2 The proposal being sought by Mr. Badzinski would reconstruct the deck (in the same <br />general location) off the rear of the home extending an additional 16 feet from the <br />principal structure, which is an additional encroachment of 11 feet into the bluff impact <br />zone and a further encroachment into the structure setback from the ordinary high <br />watermark (OHW). The new location would be a minimum of7 feet from the top of <br />bluff and 33 feet from the OHW (see illustration). <br /> <br />4.3 The Badzinski home was constructed in 1939 and lies on an approximated 8,060 sq. ft. <br />parcel that is generally 38 feet wide and 180 feet deep and has an impervious coverage <br />allowance of 2,418 sq. ft.
