<br />5.2 Section 1004.02D5 requires a 30 foot minimum rear yard setback. The Norris principal <br />currently lies just over 21 feet from the north (rear) property line. The proposed by <br />Mr. Norris seeks the ability to construct an attached garage 12 feet from the north <br />property line or an 18 foot variance. <br /> <br />5.3 Although the proposed attached garage is very large, its size is permitted under the City Code <br />(size allowed up to footprint size of principal structure or 1,699 sq. ft and ability to meet <br />impervious coverage maximum 000% or 4,491 sq. ft.). That being said, other sections of the <br />City Code such as setback requirements can regulate structure size, unless variances are <br />granted. <br /> <br />5.4 The original west lot line (prior to the frontage road construction in 1988) would have been <br />considered an interior lot side yard with a 5 foot setback applied. However, access to any <br />proposed enlarged garage on the parcel prior to the frontage road would have had to come <br />from Sextant Avenue (the frontage raid was build well after the home). The proposal by Mr. <br />Norris would place an attached garage 8 feet from the west property line, requiring a 22 foot <br />vanance. <br /> <br />5.5 The principal structure was also constructed prior to the adoption of a City zoning ordinance, <br />which now requires a rear yard setback minimum of 30 feet. The rear yard is determined to be <br />the north property line, for which the existing house lies just over 21 feet or encroached 9 feet. <br />The proposal by Mr. Norris would place the new attached garage 12 feet from the rear <br />property line, requiring an 18 foot variance. <br /> <br />5.5 The driveway proposed by Mr. Norris at roughly 60 feet wide is much larger in width than the <br />26 foot residential maximum allowed by the Roseville City Code. Staff does not support this <br />width, nor a variance to increase the Norris driveway within the right-of-way larger that the 26 <br />maximum width. Further, given the short driveway/apron depth, it would require a variance <br />Section 602.06 of the Roseville City Code if parking of vehicles in the driveway is desired. <br />However, even though few vehicles use the frontage road link, there is not ample depth to <br />provide a driveway depth of 20 feet without extending past the curb. That being said, staff also <br />does not support a variance to this section of the City Code. <br /> <br />5.6 The City Planner has reviewed the development proposal with regard to variance standards and <br />determined that it is difficult to justifY a departure from the strict application of the City Code <br />allowing the applicant to construct the proposed attached garage. However, there is justification <br />for reducing the size of the replacement garage to a size closer to the 50 feet by 24 feet or <br />1,200 sq. ft. <br /> <br />5.7 Specifically, the existing principal structure has a 21 + foot rear yard setback. Requiring or <br />limiting the attached garage to this same setback as the principal structure and allowing the <br />attached garage to be constructed at the Code allowed 27 foot front yard setback, would <br />reduce the structure from 60 feet to 56 feet. <br /> <br />PF3541- RPCA 120303 - Page 3 of6 <br />
