My client has agreed to conditionally accept the City's offer of
$60,000.00 for damages from the taking of the land upon the following conditions.

1. My client requests a separate confirmation from the City Code Inspector and
review of the new legal description of the condemned area showing that after
the condemnation the property will be left with 190 or 191 parking stalls.

2. It appears that the southern most building on the property encroaches
approximately 10.13 feet onto two sewer easements in favor of the City of
Roseville, one of which is dedicated on the Plat of Hamline Court, the second
was recorded June 8, 1959 as Document No. 1485462. The structure has been
in its current location for almost 40 years. Enclosed please find a copy of this
survey showing these encroachments as well as a copy of the easement
recorded as Document No. 1485462. My client requests that the City provide
assurances that it has no intention now or in the future to force removal of the
building from the encroachment area.
