3. The enclosed survey also shows the southern most parking garage at its
northerly end is within 4.7 feet of the west property line and at the southern
most end is 3.7 feet from the property line. Again, this structure has been in
its present location for almost 40 years. My client requests that the City
provide assurances that at no time now or in the future will the City pursue
removal of the garage due to its location which is not 5 feet from the property
line as required by the City of Roseville setback ordinances.

4. I have not received a signed copy of the Temporary Construction Easement
for the property from the City. It is my belief that the temporary easement
expires two years from October 8, 2003, which is the date your courier picked
up the easement in exchange for the City's check in the amount of $2,700.00.
Please confirm that this is the date the temporary construction easement
expIres.

5. Finally, in addition to compensation for the land taking, the City's appraisal
also provides compensation for property damage and tax reimbursement.
Please confirm how the City intends to proceed as to these items.

Please contact me as soon as possible to confirm the amounts indicated accurately
reflect the City's offer as well as if the City is willing to provide the requested
assurances.

Sincerely,
r-~-'7
(" /'i '-
,/ '\ f l/,-,.)
~ )/
"Bareis C.
