<br />ORIGINAL <br /> <br />TEMPORARY CONSTRUCTION EASEMENT <br /> <br />The Undersigned Grantor for good and valuable consideration, the receipt whereof is <br />hereby acknowledged, does hereby grant and convey to the City of Roseville, a municipal <br />corporation under the laws of Minnesota (Grantee), its successors and assigns, a <br />temporary easement over, under and across the following described land situated in the <br />County of Ramsey, State of Minnesota, to wit: <br /> <br />An area of land contained within Lot 3, Block 1 of Venture Addition, <br />City of Roseville, County of Ramsey, said area of land being 40 feet in <br />width and having the centerline described as follows: <br /> <br />Commencing at the most westerly property corner; thence <br />southeasterly on the property line at a bearing of s 57d 35' 56" e. a <br />distance of 20.00 feet to point of beginning; thence northeasterly at a <br />bearing of n 32d 24' 04" e a distance of 355.00 feet; thence <br />northwesterly at a bearing of n 33d 05' 56" w. a distance of 75.10 feet; <br />thence northerly at a bearing of n Od 21 '29" e a distance of 278.94 feet <br />and there terminating. <br /> <br />This temporary easement is for the purpose of providing Grantee access to land to the <br />north of Grantor's property in order to facilitate construction activities for the Applewood <br />Pointe Housing Project. <br /> <br />Grantor covenants that it is the owner of the above described lands and has the authority <br />to grant this temporary construction easement. <br /> <br />Grantee shall have the right to keep the easement clear of all buildings, structures, fences, <br />trees, shrubbery, undergrowth and other obstructions that may interfere with or endanger <br />the right of construction access. Grantee shall maintain the easement in the same manner <br />that public streets are required to be maintained as part of the Applewood Pointe Housing <br />Project in the agreement with the Developer noted in section 8.4 of the approved PUD as <br />follows: The DEVELOPER shall clean dirt and debris from public streets that has <br />resulted from construction work by said DEVELOPER or DEVELOPER'S <br />CONTRACTORS, its agents or assigns. The CITY will determine whether it is necessary <br />to take additional measures to clean dirt and debris from the streets. After 24 hours <br />verbal notice to the DEVELOPER, the CITY may complete or contract to complete the <br />clean up at the DEVELOPER'S expense. Snow removal shall continue to be the <br />responsibility of Grantor. <br />
