<br />Grantee agrees to restore said easement area, or any portion of Grantor's Property used <br />by Grantee, to as good or better a condition as it was prior to the time of use by Grantee. <br />Grantee will restore, repair or replace, to Grantor's sole satisfaction, any an all property, <br />including but not limited to, trees, street, curbing, sod, driveways, light, hydrants or <br />sidewalks damaged anywhere on Grantor's property by anyone utilizing said easement <br />during the term of this Temporary Easement. Specifically, Grantee acknowledges that <br />the easement overlies, in part, existing asphalt road surfaces. Upon completion of the <br />term of the Temporary Easement, Grantee agrees to do a mill and overlay to repair the <br />asphalt road surfaces on Grantor's property including, but not limited to, those lying <br />within the easement area. The mill and overlay process consists of grinding off one and <br />one half inches (1.5") of the existing asphalt surface from the roadway, replacing it with a <br />new blacktop driving surface and restriping all areas. <br /> <br />Grantee shall open the gate no earlier than 7:00 a.m. and shall lock the gate no later than <br />8:00 p.m. daily, Monday - Friday and no earlier than 9:00 a.m. and no later than 7:00 <br />p.m. on Saturday. Grantee shall keep the gate in good condition and repair. <br /> <br />Grantee agrees to hold Grantor harmless and to defend and indemnify it from any claims <br />related to the use by Grantee of any of Grantor's property during the term of said <br />Temporary Easement. <br /> <br />Grantor retains the right to terminate the Easement upon 24 hours written or telefaxed <br />notice to Grantee upon Grantee's breach of any obligation under this Temporary <br />Easement agreement. <br /> <br />This temporary easement shall expire one year from the date of execution and shall not <br />be recorded. <br /> <br />IN WITNESS WHEREOF, Grantor has executed this Temporary Construction <br />Easement as of the ~~day of August, 2003. <br />
