No. _ This PLANNED UNIT DEVELOPMENT AGREEMENT, dated June 16,2003, is entered into between the City of RoseviHe, a Minnesota municipal corporation, of 2660 Civic Center Drive, RoseviHe, Minnesota 55113 ("CITY") and United Properties Investments LLC, a Minnesota limited liability company, 3500 American Boulevard West, Suite 200, Minneapolis, MN 55431 ("DEVELOPER"). For reference, the City of RoseviHe project file is: PF 3457. 1.0 EFFECTIVE DATE of AGREKMENT This agreement shall be effective upon completion of the following: L 1 Passage and recording of Applewood Pointe of Arona (subdivision plat of property for project). 1.2 Passage and publication of Ordinance # __ rezoning of property to PUD with underlying zoning of Single Family (R-1) District; Townhouse (R-6) District, General Residence (R-3) District. 1.3 Publication of the ordinance in the St. Paul Pioneer Press, the CITY's official newspaper. 1.4 Execution of this agreement by the CITY and the DEVELOPER. 1.5 Recording of the Applewood Pointe of Arona Plat, Subdivision and Public Improvements Contract, and any City approved public easements, and this agreement with Ramsey County Recorder. 2.0 REQUEST for PUD APPROVAL In Phase 1 the DEVELOPER has requested that the CITY approve a Planned Unit Development (PUD) (PF# 3457) that redevelops one parcel into-il 7 single family homes, 1- 96 unit Cooperative Housing Building, 18 townhomes, and a 2.2 acre public park (approximately) and a 2.4 acre public park and pond area (approximately). In Phase 2 (Outlot A) of the Planned Unit Development, the DEVELOPER has requested that the CITY approve 18 townhomes or a 36 unit condominium. The current project address is 2800 Arona Street. The subject property, on which the DEVELOPER'S housing will be built will include a subdivision plat recorded with 1
