<br />Ramsey County. The project will have the following legal description: <br />Block 1, Lots 1-19; Block 2, Lots 1-7; Block 3, Lot 1; Outlots A, Band C; and public <br />streets and easements \vithin Applewood Pointe of Arona, City of Roseville, Ramsey <br />County. <br /> <br />Outlots Band C will be conveyed to the CITY by the DEVELOPER in fee title, free and <br />clear of all encumbrances as shown within the Applewood Pointe of Arana Plat. <br /> <br />3.0 pun APPROVAL <br /> <br />The CITY hereby grants approval of the Planned Unit Development (identified as <br />Exhibits A through N in Section 4 of this Agreement), subject to the DEVELOPER's <br />compliance with the terms and conditions of this Agreement. The City agrees to approve <br />applications for building permits, if said applications are consistent with the plans <br />identified in Section 4.0 below. <br /> <br />For any improvements not contemplated in this Agreement, the CITY may require <br />compliance with any amendments to the Comprehensive Guide Plan, official controls, <br />platting or dedication requirements enacted after the date of this Agreement. <br /> <br />4.0 APPROVAL by the CITY <br /> <br />The CITY hereby approves the following plans on file with the City. The DEVELOPER <br />shall develop the subject property in accordance with these plans. If, however, the plans <br />are inconsistent with the written terms of this Agreement, the written terms of this <br />Agreement shall control. If the plans address items not specifically addressed in this <br />Agreement, the plans shall govern with respect to those items. The plans are: <br /> <br />Exhibit A <br /> <br />Exhibit B <br /> <br />Exhibit C <br /> <br />Exhibit D <br /> <br />Certificate of Survey/Subdivision Plat of Applewood Pointe of Arona <br />based on preliminary plat dated May 27, 2003 and AL T A Survey dated <br />ApriI17,2003. <br /> <br />Site development plan that includes property boundary, building setbacks, <br />structure location (including the trash enclosure), curbing, and parking <br />setbacks (each individual development project), Drawing No. A1.3 dated <br />April 25, 2003. <br /> <br />Grading plan illustrating existing grades and those proposed after <br />completion of the proposed construction, drainage directions, spot <br />elevations, catch basins for surface water catchment, and the erosion <br />control plan, Drawing No. C-l through C-3 dated April 18,2003. <br /> <br />Sanitary sewer and water plan illustrating all connections, pipe sized, line <br />locations, manhole locations, hydrant locations, and other applicable <br /> <br />2 <br />
