The CITY shall not be liable for any <br />delay or default in completion of this work to the extent the delay or default is <br />caused by conditions beyond the CITY'S reasonable control. <br /> <br />G. Arona Pond Pathway: With the exception of the pathway within the PLAT, <br />the CITY shall construct a pathway around Arona Pond, at its expense. The <br />pathway will connect to the proposed trail in the southeast comer of the <br />development. This project will be completed in conjunction with the Arona <br />Pond Improvements (paragraph 3F). This project cannot start construction <br />until easements have been acquired. <br /> <br />The CITY shall not be liable for any delay or default in performance of the <br />construction of this improvement to the extent said delays or defaults is <br />caused by conditions beyond its control, including, without limitation, <br />suppliers, subcontractors, and third parties. <br /> <br />H. Terrace Drive Extension: The CITY is working on plans and right- of- way <br />for the extension of Terrace Drive from the east boundary of the PLAT east <br />through the apartment property to connect to the existing Terrace Drive. This <br />project is presently proposed for construction Fall 2003 and cannot start until <br />easements have been acquired. <br /> <br />The CITY shall not be liable for any delay or default in perfonnance of the <br />construction of this improvement to the extent said delays or defaults is <br />caused by conditions beyond its control, including, without limitation, <br />suppliers, subcontractors, and third parties. <br /> <br />Phased Development. The Plat shall be constructed in two phases in accord with the <br />terms and conditions contained in this document as well as the PUD Agreement. <br /> <br />In Phase 1 the DEVELOPER has requested that the CITY approve a Planned Unit <br />Development (PUD) (PF# 3457) that redevelops one parcel as follows: 7 single family <br />homes, 1- 96 unit Cooperative Housing Building, 18 townhomes, an approximately 2.2 <br />acre public park and an approximately 2.4 acre public park and pond area. <br /> <br />In Phase 2 (Outlot A) of the Planned United Development, the DEVELOPER has <br />requested that the CITY approve 18 townhomes, alternatively, a 36 unit condominium. <br /> <br />The project address is currently 2800 Arona Street. The subject property, on which the <br />DEVELOPER housing will be built, will include a subdivision plat recorded with <br />Ramsey County. The project will have the following legal description: <br />Block 1, Lots 1-19; Block 2, Lots 1-7; Block 3, Lot 1; Outlots A, B & C; and <br />public streets and easements within APPLEWOOD POINTE of ARONA, City <br />of Roseville, Ramsey County. <br /> <br />Page 3 of 12 <br />
