Outlots A and C will be conveyed to the CITY by the DEVELOPER in fee title, free and clear of all encumbrances as shown within the Applewood Pointe of Arona Plat. 3.0 pun APPROVAL The CITY hereby grants approval of the Planned Unit Development (identified as Exhibits A through N in Section 4 of this Agreement), subject to the DEVELOPER's compliance with the terms and conditions of this Agreement. The City agrees to approve applications for building permits, if said applications are consistent with the plans identified in Section 4.0 below. For any improvements not contemplated in this Agreement, the CITY may require compliance with any amendments to the Comprehensive Guide Plan, official controls, platting or dedication requirements enacted after the date of this Agreement. 4.0 APPROVAL by the CITY The CITY hereby approves the following plans on file with the City. The DEVELOPER shall develop the subject property in accordance with these plans. If, however, the plans are inconsistent with the written terms of this Agreement, the written terms of this Agreement shall control. If the plans address items not specifically addressed in this Agreement, the plans shall govern with respect to those items. The plans are: Exhibit A Exhibit B Exhibit C Exhibit D Exhibit E Doc# 178570812 Certificate of Survey/Subdivision Plat of Applewood Pointe of Arona based on preliminary plat dated July 8, 2003 and ALTA Survey dated Aprill?, 2003. Site development plan that includes property boundary, building setbacks, structure location (including the trash enclosure), curbing, and parking setbacks (each individual development project), Drawing No. Al.3 dated April 25, 2003. Grading plan illustrating existing grades and those proposed after completion of the proposed construction, drainage directions, spot elevations, catch basins for surface water catchment, and the erosion control plan, Drawing No. C-l through C-3 dated July 11, 2003. Sanitary sewer and water plan illustrating all connections, pipe sized, line locations, manhole locations, hydrant locations, and other applicable utility plan information, Drawing No. C-2 and C-3, dated July 11, 2003. Master fee conveyance, dedication, and easement plan illustrating all proposed parks, ponds, trails, utility and other conveyances, dedications, and easements to the CITY necessary for parks, ponding, trails, utility services, access, and parking as shown on Preliminary Plat, dated July 8, 2
