<br /> <br />March 4, 2003 <br /> <br />Mr. Edward Anderson <br />750 County Road C <br />Roseville, MN 55113 <br /> <br />RE: Application Requestfor Conditional Use Permit (PF3458). <br /> <br />Dear Mr. Anderson: <br /> <br />Thank you for your recent application submittal seeking a conditional use permit to allow an accessory <br />building on your premises. I have reviewed the information you provided and how the City Code <br />impacts you proposal, and have detem1ined that your application is incomplete and cannot be <br />forwarded to the Planning Commission for consideration and based on my review I have determined <br />the following: <br /> <br />. <br /> <br />Section 1004.01A3 (Detached Accessory Building Size Limit) reads: "Total detached building <br />area shall be limited to 40% of the required rear yard area, up to a maximum size of 864 square <br />feet. The 40% rear yard limitation is calculated by taking the width of the subject lot or parcel <br />and multiplying it by the required rear yard setback of 30 feet, then multiplying that number by <br />4 or 40%". <br /> <br />. <br /> <br />Section 1004.0 1A4 (Requirements for Increased Maximum Size) reads: The size of accessory <br />buildings may be increased from a total of 864 square feet to a maximum size of 1,008 square <br />feet. A'public hearing and approval ofa conditional use permit in accordance Section 1013.01, <br />and provided all other applicable provisions of this Section are met, is necessary. <br /> <br />. <br /> <br />I have determined that your parcel has a rear yard area of 2, 145 square feet; however, your <br />parcel is limited to a maximum of allowance 1,008 square feet with a conditional use permit. <br />Currently, you have two detached accessory buildings with a combined size of (936 & 216) <br />1,152 square feet, which size exceeds the current Code allowance. Placing an additional 924 <br />square feet is not permissible without the approval of both a variance and conditional use <br />permit. <br /> <br />. <br /> <br />Section 1004.01A5 (Overall Area) reads: "The overall area of attached garages and detached <br />accessory buildings shall not exceed the exterior dimensional footprint of the principal <br />structure, excluding any attached garage footprint." In the case of your premises, your home <br />has been estimated to have a footprint of 1,096 square feet, which is well under your existing <br />detached accessory building square foot total.
