Accessory buildings and/or a garden shed shall be located <br />behind the established front building line of the principal structure." Any proposed detached <br />structure would be required to be located at or behind the current principal structure. <br /> <br />II <br /> <br />Section 1004.0lAlO (I-Ieight) reads: Accessory buildings shall not exceed one story or 15 feet <br />in height and the building wall height shall not exceed 9 feet in height. The overall height of an <br />accessory building shall not exceed the overall height of the principal structure." In the case of <br />the proposed accessory structure, it is unclear what the wall height is, only that the building has <br />a ceiling height of 13' -6". However, it does appear that the height of the proposed accessory <br />building would exceed the 15 foot maximum height and be required to receive a variance. <br /> <br />Based on my analysis of your proposal, your submitted application is incomplete. As well that <br />application was absent the required narrative and fees. With that said, should you desire to continue <br />the process, please complete the enclosed variance application, note the Code Sections (from above <br />analysis) you feel are applicable to your request, and submit a detailed site plan, narrative, and fees. <br /> <br />The variance process will require your request to meet the "hardship" criteria explained on the <br />application. Specifically, the ten11 "hardship" or "undue hardship" typically refers to physical <br />characteristics of the property, such as shape, soil conditions, or extreme topography. Neither mere <br />inconvenience, nor reduction in value alone, is sufficient to justify a variance. The inability to put <br />property to its highest and best use is not considered a hardship or practical difficulty. The problem <br />that justifies the variance must be caused by conditions beyond the control of the applicant.
