<br />2) a setback of 0 feet on the north and south sides of Dionne from Lexington r.O.w <br />to the east property line of the development (Center); <br />3) a setback of 0 feet on the south side of Rom a beginning at the northwest comer <br />of the development (Center) to a point 145 feet east of the said comer; and 0 feet to the <br />east property line of the existing development. <br />4) a 7 foot setback on the north side of Larpenteur Avenue from the northeast <br />property comer of Larpenteur and Lexington to a point 140 feet east <br /> <br />These variances are to continue as long as the B-2 zoning for all permitted and <br />conditional uses for both the Center and the Plaza (Shoppes), and the building <br />configuration are not changed where they are adjacent to one of the setback variance <br />areas. <br /> <br />The City also received from the developers a seven foot pedestrian right-of-way <br />along the south side of the existing development (Center) for the length of the existing <br />development. <br /> <br />The developer was required to submit a landscape plan for both the existing <br />development (Center) and the project (Shoppes) <br /> <br />Parking: <br /> <br />The City agreed to allow continuance of head-in parking on the north and south side of <br />Dionne and on the south side of Roma and handicapped parking as required in the <br />parking lot. <br /> <br />Additional Parking for 01' Mexico <br /> <br />The developers agreed to provide parking spaces for 01' Mexico... in accordance with <br />Exhibits D1 and D2. Exhibit D1.. . states that Paster (Larose Corp., later called Lexington <br />Plaza Associates) agreed with 01' Mexico, a tenant in Plaza Associates' building <br />(Center) on the east side of Lexington, that parking for up to 50 vehicles from Ol'Mexico <br />could be parked on the west side of Lexington (Shoppes). This was a non-exclusive <br />license as long as Ol'Mexico was a tenant. Paster could, at any time, change the location <br />or provide equal parking on other land. (October 3, 1979). <br /> <br />On May 29, 1986, 01 'Mexico was given notice by the Plaza Associates that an additional <br />25 spaces were designated for Ol'Mexico on the east side of Lexington and reduced by <br />25 spaces (to 25 spaces) on the west side of Lexington Avenue. The provision of"D-l" <br />regarding "any location inthe lot that Paster designates" still prevails.
