<br />8.0 SUGGESTED CITY COUNCIL ACTION: <br /> <br />8.1 On May 7,2003 the Community Development Department supported the request by Mr. <br />Berger and recommended approval of the requested variance, subject to the conditions. <br />However, staff has historically deferred to the recommendations of the Planning <br />Commission. <br /> <br />8.2 On May 7, the Commission on a split vote (3-2) voted to deny the Berger request. <br /> <br />8.3 The City Council should determine reasonableness and practicality of the variance <br />being sought by Mr. Berger and make a decision to either: <br /> <br />A. Adopt a resolution approvin2 the VARIANCE to Section 1 004.01A 7 of the <br />Roseville City Code for Kenneth Berger, allowing the construction of a 24 <br />foot x 26 foot (624 sq. ft.) detached accessory building (garage) in the front <br />yard, 17.73 feet from the principal structure and 42 feet from the property <br />line, for property at 3036 Victoria Street, based on the findings in Section 5 <br />and conditions of Section 6 of the project report dated May 7, 2003; <br /> <br />OR <br /> <br />B. Continue the issue to June 16, and direct the City Attorney to draft findings <br />for a resolution denvin2 the VARIANCE to Section 1 004.01A 7 of the <br />Roseville City Code based on specified findings of fact determined by the <br />Council. <br /> <br />NOTE: The Planning Commission's determination was that options and/or <br />alternatives exist and there is adequate space without variances.
