File 3465: Request by Kenneth Berger, 3063 Victoria Street, for <br />a V ARlANCE to Section 1004.01A9 (Prohibited Location) to allow <br />construction of a detached accessory building in the front yard. <br /> <br />Acting Chair Mulder opened the hearing and requested City Planner Thomas Paschke <br />provides a summary of the project report dated May 7, 2003. <br /> <br />Thomas Paschke indicated that Kenneth Berger is seeking approval for a Variance to <br />Section 1004.01A7 to allow construction ofa detached garage 17.73 feet in front of the <br />principal structure (home) and 42 feet from the front yard property line adjacent to <br />Victoria Street. The Berger home was constructed in 1952 prior to the 1959 Zoning <br />Ordinance and lies 57.73 feet from the front property line adjacent to Victoria Street. <br /> <br />The proposed improvement seeks allowance of a 26 wide by 24 deep (624 square foot) <br />detached accessory building to be placed 42 feet from the front yard property line as <br />measured on the submitted site plan. This location encroached 17.73 feet past the existing <br />front building line, thus the need for the variance. <br /> <br />The Community Development staff recommends approval of a 17.73 foot variance to <br />Section 1004.0 1A 7 (Location) for Kenneth Berger to allow construction of a 24 foot by <br />26 foot (624 sq. ft.) detached accessory building (garage) in the front yard at 3063 <br />Victoria Street, subject to conditions. <br /> <br />a. The applicant using the lot's survey to supply the Building Department with a <br />scaled site plan with dimensions for detached accessory building and added <br />driveway for building permit application, thus allowing the Community <br />Development Department to verify the setbacks, driveway locations as per the <br />variance request, and size of the new structure. <br /> <br />b. The detached accessory structure being setback a minimum of 40 feet from the <br />east (front yard) property line and 5 feet from the south (side yard) property line. <br /> <br />c. The proposed detached accessory building being limited to a size not to exceed 24 <br />by 26 feet or 624 square feet. <br />d. The accessory structure having the door of entry facing north to reduce visual <br />impact along Victoria Street. <br /> <br />e. Gutters being installed on the detached accessory building (garage) where <br />appropriate, to properly direct drainage away from the adjacent (south) parcel. <br /> <br />f. The review and approval of a building permit being consistent with the approved <br />plans and variance. The new building to match the existing building in color <br />and/or materials. <br /> <br />Member Peper asked if Thomas Paschke could review dimensions in Section 4.4 of <br />
