(1005.01E2b) 3. Up to fifty percent (50%) of the parking facilities required for a church or for an auditorium incidental to a public or parochial school may be supplied by the off-street parking facilities provided by uses specified in subsection 4 below as primarily daytime uses. (1005.01E2c) 4. For the purposes of this subsection, the following uses are considered as primarily daytime uses: Banks, business offices, retail stores, personal service shops, household equipment or furniture shops, clothing or shoe repair or service shops, manufacturing, wholesale and similar uses. (l005.01E2d) 5. Conditions Required For Joint Use: a. The building or use for which application is being made to utilize the off- street parking facilities provided by another building or use shall be located within four hundred feet (400') of such parking facilities. (l 005. 01E2e(l)) b. The applicant shall show, and the city shall determine in its discretion, that there is not substantial conflict in principal operating hours of the two (2) buildings or uses for which joint use of off-street parking facilities is proposed. (1005.01E2e(2)) c. A properly drawn legal instrument, executed by the parties concerned for joint use of off-street parking facilities, duly approved as to form and manner of execution by the City Attorney, shall be filed with the City Manager. (1005.01E2e(3)) Section 1018.11. Special Parking Provisions or Districts A. Van Pooling Programs; Reduction Of Parking Spaces Required: Where a van pooling program exists for employees of a user of property in a business district and such program reduces the need for parking spaces, the number of parking spaces not needed because of such program may be reduced from the requirements. Space sufficient to accommodate such reduced number of parking spaces shall be maintained as open space and shall be converted to parking spaces in the event that the program is terminated or its effectiveness in reducing parking space needs drops. Approval and continuation of such reduced parking space plan shall be made by the Community Development Director. (1005.01D4) Section 1018.12. Proof of Parking Agreement A.
