May 29, 2002

City of Roseville
Community Development Department
2660 Civic Center Drive
Roseville, MN 55113

Via Fax: 651-490-2931
Email: thomas.paschke@ci.roseville.mn.us

Attention: Thomas Paschke - City Planner and the Roseville Development Review Committee

This is in response to the notification we received in the mail on May 23 of the Tim Garvin,
1812 Dale Court, application for a property setback permit hearing on Thursday, May 30, 3:30
p.m., at Roseville City Hall.

Weare the homeowners at 1808 Alta Vista Drive, Roseville, and our home and property is
adjacent to Tim and Tara Garvin's home at 1812 Dale Court. We are the original owners of our
home built in 1980 at 1808 Alta Vista Drive.

We want to convey our objection to the construction ofa roofed deck as proposed by Tim Garvin
in his application for the setback permit as we are not in agreement with the request to encroach
by six feet on the City's required 10 foot side yard setback from the property line which we
specifically abided by when we built our home twenty-two years ago.

Following is a brieflist of reasons why we object to the Garvin request.

. Diminished value of our life long investment in our property
by a permanent structure to be constructed so close to our property line

. Further deprivation of our privacy as depicted in Tim Garvin's diagram
or site plan of both properties attached to his application

. Concurrent activity and noise associated with the proposed roofed side structure
outside of our bedrooms

. Effect on existing mature trees planted on our property twenty years ago
that are adjacent to the proposed structure on Tim Garvin's house

Based on this, we requested from you today a copy of Roseville City Ordinance that governs the
setback requirements and process, and also to let you know we accept your invitation to attend
the review hearing at City Hall on May 30, at 3:30 p.m.

Sincerely,

~ lM1.d- C~iN\.e; K(,rUYl;

Thomas and Catherine (Kit) Kirlin
1808 Alta Vista Drive
Roseville, MN 55113
